    Helloo everyone :wave:

    Well, I got my CCAs (Loan and a Bank Acc) back from Cahoot.. in time..of the 12+2..
    They are from around 2001 .. (won't date them exact, in case anyone is reading ;)
    and they do (each) have a sheet with my signature and date etc .. Oh actually.. there is no date (where I signed) on the loan account one.
    It's all easy to read and well laid out etc.. (not too much gobbledegook) unlike the junk I got from Barclaycard. :rolleyes:

    Is that it.. or is there anything I should look out for.. I know Rog said something about missing payments? .. I forgot now.. :o something like that. :o

    Each one is two pages.. The first page of each is a load of blurb .. and the 2nd sheet (of each) has my signature on.

    If it clearly states at top of first page that is a CONSUMER CREDIT AGREEMENT , and at the end it has your signature . Would not want to question it in court . sorry !

    I'm not an expert, so please take this as a query rather than anything else, but aren't there other requirements as well as the requirement to state it is a credit agreement and to contain a signature?

    If it doesn't also contain the 'prescribed terms' then isn't this also grounds for dispute?

    hi can anyone tell me which letter i write next/
    i have recieved letter from original creditor saying they dont have my cca and the dca have shut the case thier end but nothing else from the original creditor.
    they just sent a blank cca with no name or details as a gesture of good will!!! thier words not mine!!

    so if they cant find a cca what letter to them now??

    Hello all. Does anyone know if the MBNA Customer Satisfaction Department (!) is the new name for the MBNA Customer Advocate office? I think it is, they have the same address....

    Hi guys,

    Hope everyones well.

    Need some advice if its not too much trouble.

    Sent 3 CCA's, Barclays, MBNA and Halifax.

    Barclays: Sent a load of rubbish presenting them as a valid CCA, so i sent them a 12+2 letter...No response but phone call today asking to call them to bring the account up to date.

    What should i do?

    MBNA: Passed the account to DCA AFTER the account has been in dispute, DCA has phoned and sent letter so in reply i sent DCA "account in dipsute" letter telling them account should not have been passed over as it is in dispute with MBNA. No reply from them but phone calls still continuing twice a day.

    What should i do?

    HALIFAX: Replied with what they say is a valid CCA but isnt, they stated that they have fulfiled their obligations and will not correspond regarding this matter... so i sent them a 12+2 letter, no reply but recieved a bill and a letter to bring the account up to date.

    What should i do?

    Any help is much appreciated.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    i thought the same, but on looking on my credit file after recieving alert( i have it online) it said new credit account added it is this debt which is now listed twice by 2 different companys both showing default. one is entered by pheonix sarl and the other listed as home shopping direct so it looks like i have 2 accounts with differnet companys in default yet its the same account???
