well i'm still trying to post the 2 cca's i got from egg and halifax but just cant seem to fathum out photobucket,
i think they both look ok but just want to make sure before i move forward0 -

Not been on this thread for a while - nothing from the DCA's which made a pleasant change but nice to see the same faces on this forum are still here.
So just an update.
Got a letter from Mercantile Data Bureau a couple of weeks back saying Hillesdon (dlc) have passed the details on to them. I had not sent a CCA request to dlc but I did send them a "Prove it" letter in January and heard nothing since... until this.
I have now requested a CCA (21st May) using the address on the letter (freepost one so saved me a few pence and the DCA pays) and find that Royal mail tell me this the letter had to be re-directed which is why it took longer to deliver. Anyway they got it 26th May so the clock is ticking.
I have heard the MDB is actually dlc but doesnt really matter if they default on the CCA request then they won't even be able to pass it back to themselves will they!
Will keep you up to date if I hear anything.
Update:
Got a letter back from "Hillesdon Securities" (strange since I wrote to MDB who said they had the "debt" - well that proves MDB and Hillesdon are one of the same) yesterday.
It reads :
Thank you for your recent letter regarding the above account. I can confirm the following:
1. I acknowledge receipt of your payment of £1 in connection with your data request under the Consumer Credti Act 1974.
2. We are still awaiting a copy of the requested documentation from our client Hillesdon Securities Ltd. When this becomes available it will be forward to you.
3. If we are unable to forward a copy of the original agreement, we will be able to supply a true copy of the document which will comply with section 77-79 of the Consumer Credit Act 1974.
Should you require anything further please contact me accordingly. I will update you on developments in 21 days if there are no developments beforehand.

Point 2 - errr it's Hillesdon writing to me - how can the client be themselves?
Point 3 - Makes no sense to me at all - if they cant get the original agreement how can they send a true copy of one?

Bet you they send some current terms and conditions or something of that sort! They'll then claim that they have fulfillled their obligations under sections 77-79 and try to fob you off!:rolleyes:0 -

Just how stupid do you actually have to be to work in a DCA, or indeed most financial institutions?. Answers on a postcard........0 -

They were my thoughts as well. And you have to laugh more since I got the original "pay up" letter from Mercantile Data Bureau which said they had been passed it from Hillesdon. They must think we are all stupid.
Ah well - they are getting the 12+2 letter sent tomorrow so thats that account in default which takes the pressure off. :dance::dance::dance:0 -
Got yet another letter back from crap quest . They say they have fulfilled the obligations, under the ACT , by sending me a signed APPLICATION FORM . It clearly states application form and not CONSUMER CREDIT AGREEMENT FORM . They say no further communications will take place and that the account is in the hands of their recovery department . So I will wait and see what happens next . But after over 16 months and several letters asking for a true signed copy of any Agreement , non has been supplied .0

FINALLY, M&S Money have replied to my CCA & SAR requests.
They've sent:
A copy of my signed application form - all looks ok.
Also sent a 5 page T&C document. The last section on the first page is headed 'Data Policy' and the first sentence says, "If you have taken out a credit card with us from 31st May 2005..."
The only problem with this is that I took out the card before this date
They've also sent another document headed 'M&S Credit Card - Important Information' (6 pages this time).
This one is more T&C's, dated 07/08. It does though contain a section headed 'If you took out your card before 31st May 2005"
To me it sounds promising, but the thoughts of others would be appreciated.
