One post then I'm out of this thread. I can understand if someone thinks they may have a debt wrongly assigned to them but anyone trying to use this to get out of paying a debt they kow they owe should be ashamed.
If you can't afford YOUR debts go bankrupt this isn't consumer revenge its consumer greed and if Martin condones this he's as bad as the rest of you.

and what gives you the right to judge people,
peoples circumstances can change in the click of a finger, and although you try and sort your finances out some creditors will not listen and are not willing to help, leaving some of us no where to turn apart from the cca route, i know i was one of them, able bodied and working, then severely disabled in a matter of days bedridden and not able to work, it could happen to anyone you included, i tried to pay my debts, and i still do pay the ones that have been helpful and understanding

If you read between the lines BH has got some issues/problems with her debt and this maybe a cry for help. BH has posted on other threads saying a similar things so if you do read this BH, maybe we can help with some advise or at the very least support. Saying 1 post and away really says PROBLEM or immaturaty.

No it says I had a point I made it there is no need to turn it into a debate. If you wish to debate the issue there is plenty of room in DT to do so.

You like everone else on her are entitled to your opinion but you cannot like everyone else on here expect to make a statement and not be challanged. Debate leads to the best posible direction to achieve your desired outcome (was it Brunell who said that or Newton?). I have already stated my thoughts as have others and it is squarely in court to back up your statement

Just received another letter from DCA . I had pointed out that I considered the application form they sent me as not complying to the required format of the CC ACT.
They replied " This copy is legally sufficient and we are not obligated to send the origanal format . blar blar blar , are satisfied the documentations provided is a agreement under C C ACT 1974. On the application form it states ,"This is a credit agreement regulated by the C C ACT 1974. Sign it only if you want to be legally bound by its terms ".
I also pointed out the statements they sent were incomplete,
" we were unaware at this time that they were incomplete .We received your letter dated
,blar blar .On receipt of your letter we contacted
and advised them that we needed your complete statement of account. These will be forwarded to you in due course .
I confirm your account will remain on hold till the relevant documentation is received in our office ."

Well I informed them six weeks ago ! Why would the OC miss out a monthly statement when selling a account to a DCA ? Could it be that have lost or deleted it ? Has anyone else come across this ?

Am I right in assuming that if a DCA cannot produce a CCA for the debt then the debt is unenforcable and therefore payments should stop? Is this true as well if the debt is over the 6 year limit? Many thanks, have been lurking on this thread for awhile and am a bit confused.

    Hope that helps.
