Are they correct in saying that they need my signature for either/both the CCA and SAR letters and if so, why have 3 other companies responded to these requests?

A signature is not legally required for a cca request, MS D, I'm not sure about the SAR.

However, this appears to be a standard response from M&S Money.

Have you sent them the letter offering to provide identification, in lieu of a signature ?

    Thanks,

No, I've not sent them this letter. Is it on the templates thread?

If it is not legally required for the CCA request, this is my main concern and they are therefore still in default. I don't believe they even sent the first letter they referred to otherwise why would they mention it again?

Both M&S and the dreaded MBNA who haven't replied at all other keep adding interest and charges to my accounts.

It's the ONLY time a signature IS required, however, when you sign be sure to enter a couple of xxxx across your signature ;)

Same here nothing I do gets through to M&S at they have decided to follow their own rules. They ignor letters, when you phone to complain they tell you to put it in writing, it is like being in a whirlpool. Expecting a statement in the next few days showing another £12 charge pus interest.

The letter is on post#10 of the 'Template Letter Thread' (thanks to fermi):

If a creditor, or dca, is in default of the terms of the Consumer Credit Act, they are not permitted to add interest, or charges, whilst they remain in default.

Hi, I sent HSBC the default letter and the letter stating I dont need a signature, and they still keep asking me for a signature, and are still adding interest to my account and have not provided a CCA. I know I was told to now complain to trading standards is there a letter for this? and do I send another letter to HSBC telling them I have complained? Also I was thinking is it worth just signing the letter with some X's or a watermark underneath to get them to send the CCA? as HSBC dont seem to be taking any notice of the default! thanks for your help.

I got a copy of my Credit File this morning.

HFC Marbles(or BoS as they are now) have placed a default notice on there, even though my account is in dispute (since August 08) and a complaint is lodged with FOS (since November) - default was added on 31 January.

First Credit have gone rather quiet.

Can anyone advise me of any steps to take next? (will SAR BoS regrards my account anyway as havnt had any notifications of the above)
No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

We've finally got a letter back from CL Finance, and a £1 cheque for our fee () saying.........
We have been in contact with our predecessors, HSBC Bank PLC, who have advised that this document is unavailable. This does not make the agreement illegal or void. Monies owing under the agreement are still due.
You have made payment towards this account. This indicates an acceptance of the terms and conditions of the agreement.

Any ideas? They are wrong about the making payment aren't they?
