The copy of the executed agreement is a new one as it only shows charges as £12 and there is no signature box on the agreement.

What they have sent you is certainly NOT a true copy of the original consumer credit agreement.

However, you must allow them the full 40 days - remembering that 'you should receive the information within 40 days' so no leeway.

I had a conversation on the phone the other day with their solicitors.
I emphasised the fact that they were already in default and that we would not have been able to afford £3,500 cash. So there must have been an agreement. They said that they would get back to me with the information I have requested.

Just to reinforce what 1810 says - you have no legal obligation to make any payments whatsoever until they provide the correct documentation.
Do NOT discuss 'payment' with them until, or unless, they provide the cca.

Today was the 37th day since they signed for SAR, 40th day since I sent it so it does not give them much time !!!

I'm sorry to hear that you don't seem to be getting anywhere, blondie. The OFT should be prepared to listen to your complaint, and you can always ask to speak to a 'manager' if you are getting the 'cold shoulder' from one of their staff.
Have you tried speaking with your local Trading Standards Office?

In a way, although I admit it might not seem like it, they have probably given you good advice by telling you to talk to CCCS or CAB - often the Debt Charities will know better how to complain, and to whom. And, whilst it shouldn't be, I remain convinced that their 'voice' carries more weight than that of an individual consumer.
I have contacted my local trading standards. They are worse then useless! I also contacted Pay Plan and was advised just to ignore the calls, althought they did write to Monument advising them of my circumstances and requested that the calls stopped. Nothing happened!!! I give up!

Lexicon - I don't know your full story but I think 11 years is enough to stand your corner! Congratulations, I'm really happy for you that its all over.

I've been 'fighting' something for 13 months now and don't think I could go through it for as long as you have.

Well done my fight with Liverpool Victoria was over 8 years before they backed down. Goes to show that if you stand firm they will take the hint in the end.

Afternoon all, glad to see poeple making progress!

have got the info from my SAR req, still no proper agreement, just statementsd only going back to 2003 (account opened in 98), some more t&c's which i know are new as they have the current reduced credit limit on.. and also a timeline of my letters and their replies etc.... and copies of all my letters to them, with some lovely notes scrawled on them..

they also included details from another customer.... should i let him know?? do i complain to
going back to mine, i think its obvious they dont have the cca when they cant even send all my statements dating back to the start of the account. they have a few more days if i go from when they signed for it... from me sending it the 40 days is tomorrow..

i spoke to trading standards about them not supplying the cca, but beacuse its for over £5000 they cant help, but she did say that i had covered everything they could do and that im getting good advice from somewhere!! GO GO MSE'ers!:money:
Please be nice to all moneysavers!
