Heres a thought ! If you are disputing an account with a DCA , and they have bought the debt from the OC . If it is a CREDIT CARD account , how likely is it that all the monthly statements are forwarded to the DCA ? Say you were with a CC company 6 years , there should be 72 monthly statements available . Given that some of the DCA can not provide a CCA , WHAT ARE THE CHANCES THEY HAVE COPIES OF 72 MONTHLY STATEMENTS ?
For a court case you are entitled to see all documents that the other party are doing to rely on in court . If an account is in dispute , could be that you are unsure the amount claimed is correct . Providing the monthly statements showing all spending and any payments is vital .
I bring this point up as I was sent a years worth of statements from DCA . Only trouble was , for them , one month was missing ! And as I paid monies into the account online without really checking payment the next month , I am sure I made a very large payment that month !0 -

Today I have sent for a copy of cca from a company called EOS ,for a debt of mine passed to them by Grattan, I have had the account with Grattan for approx 12yrs, so what chance do you think I have in them providing a CCA, has anyone had dealings with EOS? Feel a bit scared now after reading oher posts on this,too late now its on its way to them!0

Just a very brief update from Trading Standards - the gentleman dealing with my case is now referring it to a colleague in the Enforcement Section. Not a clue what that means for me really!LBM: 14.01.08 - Debt at 25.04.08: £7420.925.06.10: 3200.00 :T I'm over half way there!!! :j

on march 31st i sent moorcroft a CCA request with the required fee,they got it on the 1st of april, i have proof of delivery and copies of receiving persons signiture, I should have received a reply by 22nd april, but as of yet no cca even thoygh they say they are getting it from my original lender, if so then why has my debt been sold to moorcroft without all the paperwork. I have no funds until monday to send a reminder to them, i did try to send a second notice via internet but their site email is not working.
Did you get aletter of assignment from the original lender stating that they wwere passing you on to a DCA, who it was etc? If not then they have not followed the correct legal procedure. It is also my belief that debts are sold on with no [paperwork at all apart from name adress account no etc.0 -

That is, unfortunately, all too often the case. However, if the dca is well known at Trading Standards they may well follow it through, or even use it to build up a case for rescinding the licence of that particular dca.
You would, shineyhead, be perfectly entitled to enquire, after say one month, what action TS have taken in your particular case.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Grr Capital One and Bank Of Ireland Credit cards have supplied me with CCA's from 01 & 03, didn't think they would of kept them, and they are the real things which say everything they are supposed toThis is a system account and does not represent a real person.
