Certainly shows how insecure they must be when they have to repeat, twice in one thread, that the 'forum' is for the 'exclusive' use of members of the 'Credit Industry and recognised Consumer Bodies'.
Perhaps they would do better to follow the example of this forum. :rolleyes:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Update :
Posted my 12+2 days letter to 1st Credit today (hopefully they should get it tomorrow). I have heard nothing from them since the CCA request (on 3rd Feb) - I would have thought at least they would have sent me a valentine card!0 -
Have decided to request my CCA's from Egg Credit card, barclays bank, and MBNA loan.
all these accounts were in a DMP which i canceled in SEpt/Oct 08 with view to making full and final settlement offers. This plan of action is still ongoing, with the usual to-ing and fro-ing and not really achieveing very much with it.
am getting so many phone calls and threatening letters during this time.
so plan -
1. send one final letter to each regarding the full and final offers. enclose also a letter demanding they stop the phone harrasment as i want everything in writing only
2. send CCA requests
planned outcome is they all accept the full and final offers and confirm that no other agency will pursue me in future for these debts OR as they cannot provide the CCA's they write off the debt and remove all the info from my credit file.
am womdering which will be the quickest approach as am being threatended with debt collectors, defaults and CCJ's which i really do not want and so i want the tidiest possible outcome.0 -

Hi all,
I've received a reply to one of my cca requests as follows:-
We refer to you recent correspondence.
From your request under the consumer credit act 1974 we can confirm that
we are currently in the process of requesting the relevent documentation
on your behalf from the original creditor.
We would point out that, as we are not the original creditor the act allows
12 working days plus 30 further days before we are entered into a default situation.
We believe we are exempt from this due to the processes sometimes required in order
to obtain the documentation from the original creditor.
Once we are in receipt of the requested documentation we will provide you with copies.
Is this true or are they stalling for time?
The request letter was sent 11th Feb and signed for 13th Feb.

Hello again,
I need more advise please,
A dca who I had asked for a cca from and who has already confirmed
they can't provide the cca requested has started calling my home and
hanging up (I googled the number).
I sent the 12+2 day letter and stopped my small monthly payment just
recently.
These calls have been happening over the last week.
The dca told me in their letter that my monthly payments were admission
of liability even though they have admitted they can't provide my cca.
What do I do now? and how do I stop the calls?

One more piece of advise please,
I have received a copy of my cca from a dca and I have realised I
defaulted on this debt in June 2001.
I unfortunately started making token payment to this debt again
in Jan 2008.
I have been told the debt is "statute barred" after 5 or 6 years.
Does this apply to this debt as I have been making token payments
for over a year.
If I can now claim it was statute barred as a period of 6 1/2 years
had elapsed before I started token payments, what is my next
step? can the dca take it to court?
