Ok i wont go into the gory details of my accounts ill put it simply i think :-S
I called hfc regarding 3 accounts , they said it would be best if i offered over the phone a reduced final settlement, i know this is wrong it should be in writing. Im thinkn if i negotiate for something that suits me and i get them to send me this in writing that would be a good thing ?
3 accounts with hfc,beneficial
1 account with link financial
Currently with gregory pennington making £290a mo for another 35mo= £10k
TOTAL balance with creditors= £7600
job unsafe
gregp unco-op with making a reduced final settlement have to do it myself without their knowledge.
Who are Gregory Pennington? Are they dealing with your debt management? If so the chances are they are taking a slice of the £290 hence they dont want you to do final settlements - they lose their monthly income - probably around 15% of the 290 (£43).0 -

I dont know about anyone else, but i really am getting fed up with these consumer advice web sites which tell people how to evade paying their debts effectivley.
My company has had so many letters recently informing us of what we can & cannot do.
Everything from...not being able to visit debtors homes without prior permission to having to provide credit agreements etc..
What can be done about these websites?
They are costing us too much money/profit & i know they are having an effect on other debt collection companies as well.

As the draftsman of the Consumer Credit Act 1974 I would like to thank Dr Richard Lawson for his interesting and well-argued article (30 August 2003) on Wilson v First County Trust
Ltd [2003] UKHL 40, [2003] 4 All ER 97.
Dr Lawson may be interested to know that I included the provision in question (section 127(3)) entirely on my own initiative. It seemed right to me that if the creditor company couldn’t be bothered to ensure that all the prescribed particulars were accurately included in the credit agreement it deserved to find it unenforceable, and that the court should not have
power to relieve it from this penalty. Nobody queried this, and it went through Parliament without debate. I’m glad the House of Lords has now vindicated my reasoning and confirmed that nobody’s human rights were infringed.

Oh diddums. :shocked: :shocked: :shocked:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi all,
I got a letter on Satuarday from a dca who cannot produce a copy
of my cca.
I had been paying the dca a small sum each month, the letter was
telling me that they still expect my monthy payment to be paid on time
or else (blah,blah).
They say my monthly payments are proof enough that the debt is mine
and therefore now enforcable.
I would now like to stop payments in light of them having no cca for me.
Can I do this?
Is there anything the dca can do to me if I stop payments?

Having been taken to court in Oct 2008 by Arrow Global who bought my original debt from Paragon Finance who's loan i took out in 1998, the court instructed AG to produce my signed CCA within 21 days. Having been back to court this week AG have not been able to produce my CCA 4 months later so the court have issued an Unless Order that they produce my signed CCA within the next 28 days or my alledged debt will be stuck off as it's unenforceable.
I now need any advice on were to start to reclaim any monies paid to AG because they bought a debt with out a signed CCA making any action unenforceable.

Sounds like you could get a good result there, best of luck!
Try and get your money back if you can and if I were you
I'd try for some form of compensation because you have
been wronged.

You dont have to pay them anything unless you want to - you can set the amount each month from zero to the whole debt. They cannot force you to pay money nor can they can ask for it - they dont have the paperwork and they know it.
I was in the same situation with Lowell-life last Oct/Nov and when they wrote and said they cannot produce the CCA I stopped all payments. I have heard nothing since!0 -

I request it and i got the agreement listed below but it looks like the application form to me.

I think you really need to post this up on the CAG forum as they have more experience in considering the legibility of CCA's0 -
If someone in the credit industry would delete all records of my alleged debts ,and maybe send me a small compensation package . I would be only to willing to stop any further advice to others on this website .:rotfl: I THINK NOT !0
