so would you advise i claim the value of the 2 phone's to be £200 each rather than £130 to be safe or what?0

i cant advise anything,however if you state £200 then you will be charged on £2000

You will only pay duty on the price paid so long as the seller includes all the correct paperwork and completes the CN23.
You may be better asking the seller to send them in 2 separate parcels a couple days apart and pay the extra postage. This will work out cheaper for you, as each parcel will be below the £270.00 Customs allowance0 -
so what paperwork should i get the seller to include as i bought the item from ebay so you dont get a reciept like you would in a shop? Also should i get the seller to mark the item as normal or as a gift?0

Did you pay by Paypal? I assume you will have documents or something you can print out to prove how much money changed hands and this is what I would have the seller declare as the value - he should put a copy of the INVOICE with the packing note. If it was £130 per unit then fine. Should seller say gift or commercial goods? It does not matter, you will be charged the same either way based on declared value. I suppose s/he could say "sample".
edit: salsar12 - where did you get the £270 figure from? I know is used to be that under about £20 was tax free by post from outside EU - has there been a change?
I have also seen this this info: "£145 worth of all other goods including gifts and souvenirs" tax free when you bring things personally from outside the EU - see This HMRC Link0 -
yes i payed via paypal so thanks i will get the seller to print off an invoice and put that in with my iphones. Also going to get him to post them seperatly a few days apart to reduce the chances of them being taxed0

Off the back of the customs label I have here in my hand (CN22) It says...
"If the value of the contents is over £270 you must use a CN23 form. You must give the senders full name and address on the front of the item"0
