Chargeback by paypal :(

Hi everyone, thought i would post on this thread hoping to get any help and to help others who may get into the same situation.

I sold a £50.00 voucher on ebay end november and all was ok, he paid via paypal (didnt notice he wasnt confirmed i had never come across it to check before) and i sent recorded delivery. Last week i got notice from paypal that i was having a chargeback!!! never seen one before so i went to paypal and did some reading and saw it was for this voucher the guy says his card was used without his concent... he has feedback of 6 and for 3 of those items 3 different sellers he has filed chargebacks as i asked them :(
so this guy opens a paypal account and ebay account... buys 6 items signs the recorded delivery slip in his own name and then files a chargeback...
i have put the recorded delivery info into paypal and tried to contact the buyer but no response through ebay... what else can i do to hope that they award in my favour. doesnt seem fair that someone can keep the goods and get money back! but guess life is never fair and i am too honest to think any different.
Any advice is appriciated and i am not selling on ebay i just could not use the voucher myself so cashed it in... now paypal is in debt...
Many thanks
Haynrich

I would contact the police as surely this is theft and / or fraud?

Was the payment Address Confirmed & Are you eligible for Seller Payment Protection?
If so, then the funds should be returned by Paypal
If not, then contact the buyer & ask them for payment via another method otherwise you'll pass the debt to a collection agency with incurred costs added to the debt (Soon gets a response)

accept the fact that you are definitely going to lose the chargeback and concentrate on liaising with the other sellers targetted about persuing the 'buyer' for loss through small claims.

You have proof of delivery and you have an address that's all you need for small claims. Firstly send a message to the 'buyer' saying that goods were sent and accepted and whilst you appreciate they say the card was used without their knowledge you will still need to recover either your goods or payment and that you are taking legal advice. Sometimes that is enough to make the buyer remember authourisinf the payment after all.

Dispute it, Its not your fault, Its Paypals fault. A similar thing happened to me. I never paid, My account got closed which is no big loss, NCO annoyed me for a month or 2 and 2 years later I've heard nothing else.

How can it be paypal's fault when they recommend only sending to confirmed addresses?

There is a checklist on the sticky thread 'useful links' post 16 , if you can't meet all the criteria for seller protection you need to decide whether to send or not. personally for smaller items i never bother with confirmed addresses, but then that is a risk I understand and accept.

While everyone should be aware of the rules, it is to a certain extent Paypals fault because they leave their system open to abuse. It's a bit like me leaving the front door open while I'm out and putting a notice on saying "Only the owner of this property may enter".

Paypal could sort it out once and for all by only allowing coonfirmed address to be used.
