Is the person you commissioned a psychiatrist? I get a bit excited about people deciding, often on appearances, that a person is not mentally ill. I can't make out what your story is all about but I'm sure a doctor, especially a GP would rather have the very good income they get now since the last big rise they had. The way he has carried on in court, sacking lawyers etc makes him sound unhinged (shades of Mrs McCartney). Sorry if I am seeming a bit thick but what effect on your lives does the behaviour of this man have? If you are not being affected financially or physically by this person's behaviour why don't you just leave it alone as other people have suggested?0 -

I agree you can't tell peoples mental health looking at my husband you would think normal nice guy why is he not at work. He has a acquired brain injury he had a stroke and is both mentally and physically disabled.
The reason OP is asking is because she should be getting CSA money from the person concerned. But if he is on benefits you should be getting a £5 a week anyway.

I'm not sure what you can do about it though OP as you seem to have tried so much already.
Why was the medical opinion you obtained not accepted? You say medical opinion has overuled everything else but how can that be if they have ignored the medical opinion you obtained?
Really though, he is not doing himself any long term favours if he is faking (he is going to extraordinary lengths to evade the CSA imo - he must be really miffed to disrupt his life like that).
I know it's not much consolation to you now but if all you say is true, give it a few years and you may end up having the last laugh.0 -

Summary:
GP says he is unfit to work through mental illness, DLA medical assessment doctor says his disability is such that DLA can be awarded and the DWP Incapacity Benefit doctor says he is unfit for work. Presumably consultants have also agreed he is mentally ill.
OP believes this is made up and a judge agrees. OP wants a DWP investigator to look into matter.
The real world:
DWP will look at the referral but almost certainly pass it for a compliance visit, not a formal investigation, unless he gets a higher rate mobility or care component.
There is almost no chance, without independant alternative evidence or medical opinion, if he had his benefits removed the DWP decision would hold up at an appeal tribunal.
However if he receives a higher rate DLA component(s) it may be investigated because the conditions to receive the higher rate components are strict and, if fraudulent, easier to prove fraudulent by watching what he does day by day.
Think, rightly or wrongly, what is bulk of current medical opinion saying about this person.
If you make a referal to the DWP fraud team try and give them as such information about his daily lifestyle as possible.0 -
I am guessing this man is your Dad - he seems to have gone to extraordinary legnths to avoid making any payments (which I imagine dont just include CSA payments) - this in itself could be seen as some degree of mental instability -I am aware of absent parents who have reduced their hours etc to avoid CSA payments but a doctor who has trained and given his life to medicine to give it all up to go on benefits - whether spite is involved or not, he has to have lost it to some extent. For you to be able to prove any of this is going to be really hard and draining on you emotionally - you have done al you can in writing the letter - maybe best now to let it go and concentrate on the positive aspects of your life.I have had brain surgery - sorry if I am a little confused sometimes

Yeah we realise its gonna be an uphill struggle but ive now got a contact at the local office who seemed interested in seeing this judge's comments (thanks again sarah for suggesting this), so we are sending that off to him. we can only hope and will update if anything significant happens.
Btw, i didnt realise the dwp had their own medical assessment, but again as hes a doctor he knows what to say/do/symptoms to present. i do hope we will get the last laugh, hes living a rubbish life in a council flat at the moment and could command a salary of over £40k easily, not sure why some people even have kids if this is how they turn out!! thanks for your replies

I work with people with mental health problems and I have seen many people who have previously had successful careers but their illness has prevented them from working. Depending on the individual circumstances the persons behaviour can vary greatly and in some cases it may seem to an outsider that the person is not too bad, they may even exhibit grandiose ideas and be convinced that they are right even when it is clear to others that they are not. What the judge observed may actually be symptoms of the man's illness, after all the judge is qualified in law not medicine! It seems very unlikely that someone could fake a mental illness convincingly and then get so many people to support the diagnosis. It is much more likely that a life event or a traumatic situation may have exacerbated the illness. I guess that even if his symptoms diminish there may be a number of obstacles to overcome before he would be able to work as a doctor again.
It sounds as if you have had a really hard time, I'm sorry. You have raised your concerns and now you probably need to leave the 'powers that be' to decide if his illness is genuine. For your sake as much as his it may be time to let go.0 -
Im concerned as to how you can say hes not "mentally ill" if your not medically qualified. It is hard to determine if someone is mentally ill as you dont know what medical illness he has or the symptoms of this illness.

I cant see why someone earning so much would intentionally choose to live on incapacity rates.

1..Hypothetically speaking - by the time a high earning absent parent pays maintenance (that may include mortgage, school fees etc) then they will not be left with any more than he can receive on benefits by the time he receives his IB, housing benefit, council tax benefit tc etc.
2..because this person is related to the OP - they know him, know his ways, know what he`s up to (alledgedly) and they are peed off - this is not just Joe Bloggs down the St that the OP thinks may be pulling a fast one.I have had brain surgery - sorry if I am a little confused sometimes
