they've not taken the flat off the market

I have had an offer accepted on a flat I like with Halifax estate agents, but a condition of the offer was taking the property off the market and not having any more viewings.

I have just checked the website and the property is still there, not even 'under offer'.

Do I have a right to demand it be taken off the website and for sale sign taken down etc.?

or can they do as they like? I've instructed valuers and solicitors etc.

  • they've still not done it, I've instructed solicitors, paid for a valuation survey and asked several times now

    I am gonna ring tommorow and say I want it done before the end of the day, what should I ask for? 'under offer'? or 'sold subject to contract'?

    It doesn't matter, they both mean the same thing :confused:

    Talk to the vendor! They are the ones who will instruct Halifax on what to do. It really probably is just laziness or oversight.

  • Not a repossession by any chance is it? If it is, the liklihood is that it will remain on the market until exchange of contracts.

  • Doubt you'll have much competition in the current climate anyway, unless it was a massive bargain.

    get a friend to phone up and see if they can book a viewing, you will find out there and then if they have taken it off the market. If they havent tell them that the offer has now dropped 10k!

    yes yes yes

    find out if they are ACTIVELY marketing the property and STILL taking viewings. this indicates the vendor is looking for a better offer/other buyer. in which case as maximus borillius said in Gladiator "on my order unleash hell" (cue music and roman army)

    our property was much the same, I sent my dad in to enquire about it and the EA told him politely and firmly it was SSTC and no more viewings. it was still on the web with no SSTC.

    most likely cause is a lazy EA (never), or not being able to immediately get rid of all traces of a property on the internet

    get a friend to ring up or call in.

    Tucbiscuit, does any of the correspondence you have received from the Halifax EA, list your condition of the property coming off the market & no more viewings taking place? If it doesn't, this information may not have been passed on to the vendor. As has already been said, if its a repossession it will have to remain on the open market until exchange of contracts, the vendor will not act on your demands in this instance.
