    As hard as it will be to contact your creditors, it really is better to keep an open dialogue with them at all times. They will help, but only if they know about the situation, and are more likely to help if you are upfront with them. So rather then missing payments etc which will affect your credit rating.

    Have you spoken to CAB yet?? they will be able to give very good advise as well.

    i may be wrong here but earlier you posted you are getting £66 from sickness benifit but surely if you have 3 children then you should be able to claim tax credits etc.

    are you getting any other benefits at all.
  • Taz good point but no i am actually getting nothing to date my last pay was paid upto May and i was notified in June so mid June was the last penny i got to date i am waiting for the benefits to sort out and make a payment to cover sick pay and income support i believe but as for what and when i have no idea and hey what do i matter to them they got there wages so i am just another number in there process system regardless of the fact i am having to run up debt i cannot afford to maintain everything, until these people see fit to pay me..... I am so sorry if I sound bitter here I dont mean to be I am just so annoyed I am being forced into a situation and it wasn't of my own doing The bills i had before the accident were all well managed and very much under control now i feel i have no control what so ever..

  • I have drafted a letter to my solicitor to ask for an interim payment to cover some of my wages lost.... he has the details already and i did suggest this verbally in May and July to him but he gave me the impression he wanted to go for all together or nothing until it is finalised and i return to work .. I did not imagine being away from work this length of time though if i am honest.
    The reason i dont want to say anything to my credit card companies is I am frightened they will reduce my credit and although i dont want to run them up I cannot live without them at present... as i said earlier they are the only form of finances i have got until the sickness see fit to pay me what i am due. I do not abuse them but need cash to cover bills and feed me and 3 children till then.... This is an awful situation to be in and i hate it totally when my credit insurances have paid there last instalments or i go back to work then i will be left with a mountain of debt that i could not control because of this blasted accident and when i say a mountain i mean around 55k not including my mortgage hence why i am a nervous wreck

    It sounds as if you are adding perhaps £1500 pm to your credit cards, with no sign of any income to come, other than the possibility of an interim payment. The cost of credit must be adding £1000 pm to you debts by now as well. The sooner you get professional advice the better, I really do recommend you contact the CCCS very soon as there will be a delay of at least a few weeks before your telephone appointment.

    Definately do not let your solicitor push you into anything like settling.

    Also I would advise you to find out if you can drop the solicitor you have through your car insurance and get an independant solicitor with legal aid (you must be entitled to legal aid by the sounds of it)

    I had a quite critical car accident when I was 18 after being driven into by a drunk driver. Anyway, to cut a long story short, the solicitor I was asigned through my insurance told me I wouldnt get a penny towards myself (I had a crack in my spine as a reslut of accident), my car (only 3 months old) and my friend. Luckily my parents friend was a solictor and took my case under legal aid (was a student at the time) and we won and was paid injuries, car and all expenses linked such as loss of work (part time work) detremental effect on studies, travel expenses as a result of loss of car etc.

    I waited 8 years for injuries, but was paid for my car etc after a few months.

    Ask at CAB if you can change off of solicitor (who specialises in car accidents) and be liable for legal aid.

    By the time the mortgage insurance runs out in November you will be through the 39-week waiting period to get mortgage interest paid through income support. Now, I haven't checked any of the fine print on this one so suggest you run it past the CAB. If the mortgage includes debt consolidation or if it's over 100k, there still might be problems. That's the only secured debt, isn't it?

    What's the reason in the delay in paying you incapacity benefit/income support if you have no income to live on and are supporting 3 kids?

    Have you also posted on the benefit board to see if anyone can give you help/advice on speeding matters up?

    What is the point in her waiting 8 years to get her car insurance money. Surely push for a closure settlement now so she can save the rest of her life. It sounds like this payment is the only thing that will stop her from losing everything.

    I would also contact all your creditors and ask them to freeze you interest or else you are sliding down the debt slope slide with no brakes. Tell them your circumstances that you were in a car accident and are waiting a payout - get solicitor to tell you a date or estimate settlement price as well.
  • Accidnets have to be paid out no longer than 3 years unless an apeal is made to go to court and then it can be a case of how long is a piece of string. Most cases are paid out between 1 and 2 years now to prevent hardship for the claiment. Doesn't always work mind.
