I Am Soon To Lose Everything !!!! How Can I Stop It

I am forcasting that the inevatible is due to come very soon. I need advice now rather than later....
I was involved in a car accident last Oct (2004 severe whiplash injuries) and was doing ok till then but had just taken on a 23k loan to consolidate some of my cards and do home improvements i declined ppp on the loan ..... stupid i know but never away from work so thought it was silly paying for it. The day b4 i had accident i cleared two large amounts on cards totalling 13k (these were insured) then went on family holiday day after and was unable to see my doc till 3 weeks later i even came back and stuggled to work for a week before nearly collapsing ( lots of pain and secondary complications) still off sick and no end in sight. I have not been able to do home improvments i needed the money to live along with the use of my cards but its all gone i have nothing left the insurances on cards and mortgage expire in November and no forcast to go back to work by then. there is no insurance on two cards and two loans all other items apart from utilities are covered at moment and i have maintained every payment to date but cannot do it any longer i live on £66. a week which is about to be paid by the sickness benefit and i have 3 children to support a mortgage ect ect. I have always been very good at managing my bills and pride myself on good credit record but I just dont see how i am going to deal with this I see bankruptcy looming and i am scared stiff for my children and myself.
Does anyone know of any solutions that i can look at before November arrives. I just feel i am in a stale mate here as most options rely on you having an income of some form this was not my fault and i am very recentfull that some careless driver has put me in this position :mad:

    Sorry to hear about your situation.

    1. What are the details of the car accident? Was it the fault of any third party - if so, are you able to make a claim? You may need professional advice on this point (but lets see what others post first).

    2. Have you made sure that you are claiming any benefits that you are entitled to?

    3. Are you receiving any sick-pay from your employer (how long on full pay)?

    Money out
    1. Contact your various creditors and appraise them of your situation. They will be much happier having been told of the situation than having you simply default on payments because you have insufficient funds. Try to get any interest charges frozen and agree a payment plan. The CAB will be able to help you with this if you ask.

  • Richie thanks and in reply to this i can tell u both myself son and daughter were injured and yes they have been paid out. I however have not as they dont want to suggest a final figure as no final date to return to work in sight and they are calculating my loss of earnings but still not paying out yet ((( this would help drastically ))) I was paid from employer approx £70 pw for 6 months but that expired in may and they informed me in june of such so i made claim for sickness benefit still awaiting getting a penny this in turn is making me ill not better (( another secondary to add to the list))
    Like i said i am in a stale mate as nothing is happening and i dont want to get into bad credit if things can be avoided
    i have racked my brains trying to think of solutions before the November month hits the fan and should it reach that any settlement i get will no doubt be swallowed up immediately although any debt is personal and not linked to the home only the mortgage

    Just ask your insurance company to file for a specified amount and do it now. It seems its the debts that are causing you more illness than your car crash.
  • I spoke only days ago with the solicitor dealing with my case and told him i was looking at going into Bankruptcy soon if things did not progress in some way I told him my concerns but i feel this fell on deaf ears. He is appointed by my car insurance and is pushing for a settlement so he can get his pay but i feel he is also more of the mind that i worked for the week after the holiday (( which was 14 hours after accident the initial whiplash had not kicked in and i am one of those that plows through illness to get better unfortunatley it didn't work out this time )) so i get the impression he thinks i am or should be all fit and well now.
    This is a horrible position to be in I dont like asking anyone for anything and to be frowned on by my own solicitor does not give me a great deal of confidence

    If i could i would be at work now then this discussion would not be taking place and i would not be feeling like my world is about to collapse

    Hi CC,

    Go to the Citizens Advice Bureau and see one of their debt counsellors. They will give impartial advice and help you put a hold on all of your creditors, i.e. freeze interest and make nominal monthly payments to each of say £2. Bankruptcy is not in sight for a long time. They can also advise on any other benefits you can claim for.

    Firstly, your solicitor is acting for you not your insurance company.

    Secondly, please put in writing to him how desparate your situation is and ask him to ask the other insurers for an interim payment. Liability is clearly not in dispute and you can show what you were earning before the accident.

    Also, if you solicitor is experienced in personal injury he should know that injury can be ongoing. It is right that you should not push for an early settlement. You should not receive your final payout until your prognosis is known.

    There is a forum member called andyd who is a personal injury lawyer. Send him a PM and ask for some advice.

    Please DONT accept a final settlement till you are CERTAIN that you have suffered all that you will.

    It is very easy to look at the 'now' situation but I am still suffering from an accident but accepted a payout far lower than I should heve. If I knew then what I know now ..Etc.

    If that solicitor is acting too slowly you do have a recourse to the Law Society.
    As mentioned, check with the CAB. They can advise.

    Just so that you know, a few years back I was also being represented by a solicitor via my insurance company - she was also trying to get the case settled quicky (ie trying to get me to settle for 20% liability on my part, which would have meant that I could not have made my personal injury claim at all, even though I was not at fault in any way)

    Anyway, I argued the point, it didn't go down very well and she said 'I've got case studies blah blah blah etc I can sent them to you if you like (really sarcy voice)' so I said 'yes please, I'd like to see them'.

    I went through the pages of approximately 20 different case studies which were sent and not one of them was similar to my situation, so I got right back on the phone - end result was that I certainly didn't admit partial liability for something which wasn't my fault and I succesfully claimed for my injury.

    I suppose all I'm trying to say is don't just rely on your solicitor to do what he's supposed to, keep on his case about it.
  • to all that have put forward there help i just wanted to say thank you i want you all to know i am aknowledging all the suggestions that have been put forward
    I do however not feel comfortable contacting my creditors to tell them that things may go belly up because i have always had a good credit rating and currently need this line of credit to keep things a float.
    I just feel so trapped in a situation that i was not responsible for and this makes me so mad and upset. If i had blatently just blown my finances to the wind then i could accept this situation and deal with it.
    The thoughts of having to go into a Bankruptcy order terrify the living day lights out of me and losing my house would be the final nail in the coffin.
    I know i cannot go for IVA due to no income. All i see is November looming and no change just a heap more debt in order to live
