quite right, money taken, contract formed, they must oblige. no money taken, no contract.
The fact they have taken the money DOES NOT form a contract, they can refund you and not supply, just as B+Q have just done with the "SHED" and loads of other traders have done over the years
• Ok thanks, does anyone know when they're likley to refund?

Ok I put it as I understood it, based by personal experience.

How come that trading standards work to the rule about contract formaed when money taken. Maybe B+Q did break the sales of goods act? Maybe no one took the shed offer any further? I dont know.

Dear MSE User

Thank you for your recent email. Please accept our sincere apologies for the disappointment caused by the incorrect price of the Bouncy Castle which was specified on the Focus website recently.

We would like to take this opportunity to reassure you that no money was taken from your account. We only request payment for goods for which we have issued an order preparation confirmation. Your bank may, however, have reserved an amount equal to the value of your order to ensure that sufficient funds were available in your account. It should by now have cancelled this reservation.

Whilst we are not liable to you for our error we do recognise the dissapointment and inconvenience this has caused you and would like to offer you a £30 voucher, as a gesture of goodwill, which you can redeem against either of our new bouncy castles which will be available to buy instore from 5th May 2008.

If you wish to accept the above offer please write confirming your acceptance and quoting your order number, to me at the address highlighted below. On receipt of your letter we will send you the voucher to redeem against one of our bouncy castles.

Please find details of our two new bouncy castles for your information below.

Once again we apologise for the disappointment and any inconvenience we have caused.

sounds like a trade off, you accept the voucher in order that you dont have a comeback to get the product. paying you off maybe???? still, £30 not bad.

lol, but the current one is £70 anyway! so you're not saving anything by using a £30 voucher on a full priced item (now they've sorted the misprice out).
