How would they get away with not refunding postage cost when they didnt post or pack anythin??

I dont know, but when it says about refunding it says they refund the items then next to the p&p it says £0.00 as if i havent paid any...

They've also taken the money out of my account..
  • got my cancellation as well:mad:

they took my money straight away, so have emailed them to ask for my money to be returned! still have e mail they first sent with total inc p& p for proof!

i keep losing weight, but it just keeps on finding me!!!!!!:D
  • So are their t&C acceptable.

Surely as part of sale of goods act and taking money is misselling.

They didnt display the original price so I certainly went into purchase in good faith!!! It said save £30 but how was i supposed to know that it wasnt £30.70p originally??

Feel there is surely something more to this.

Their T&Cs cover them very well in these circumstances.

Im no legal expert but from my limited experience the sale of goods act states that a price advertised is "an invitation to treat" and as such you can agree to pay such price ie 70p and focus can choose to accept it by taking your money.

Once money is taken then a legal contract between both parties is formed. Yes it may be a misprice and they identify it and cancel orders, thats their right but that must happen before money is taken from the customer for the item, and then they decide to change the price thats too late for them, the contract is formed at 70p.

They may have lots of nice words in their T+Cs, thats fab but if it contravenes the Sales of Goods act then it does not matter what they put on the website.

There was an issue with dell advertising external hard drives for £20 and some people got their money taken, and some had to wait a month or more for the refund which is totally unacceptable ,most people just accept it, and wait for the refund but I know a couple of people fought it and Dell were told to supply the item at the advertised price to those people.

There are literally hundreds of misprices listed on this website, most orders get cancelled, I know as I order most just to see if they take money. To date I have never had money taken for any of them so have nothing to argue but the day they take my money and then tell me it was wrong I will fight it.

I know most people wouldnt/couldnt be bothered for a 70p bouncy castle but these retailers need to get their houses in order with regard to pricing and if some people take it up with them they might learn their lesson.

So after a longer than expected reply, if you had your money taken (70p) for this bouncy castle I would take it further, trading standards ( consumer direct) are a good start. Depends how much you wanted it in the first place
