Just found this regarding Statutory disciplinary procedure
What is the statutory disciplinary procedure?- If an employer is contemplating dismissal - or action short of dismissal such as loss of pay or seniority - they must follow a three-step disciplinary procedure. This statutory procedure involves:
- a statement in writing of what it is the employee is alleged to have done
- a meeting to discuss the situation, and
- the right of appeal - If an employer does not follow the minimum procedure then an employment tribunal may judge the dismissal 'automatically unfair'. Compensation will increase or decrease - by between 10-50% - depending on whether the employer or employee failed to adhere to the new law.

Hi, you seem to imply that 'others' have been BR and not treat the same as you ? That is discrimination. You need to send a 'step one letter' to your employer. To be quite honest ive had a few beers so please pm me tomorow and we wil have a chat.

but if you win a case for unfair dismisssal, and get an award/payout, the OR may snatch it, and RBS may get some back.......strange old world int itNow we all know how it felt to play in the band on the Titanic...0

I just want to thank everyone for your supporting comments and advice. So as to not seem rude, I wanted to give you an update on my battle with RBS.
The format that the HR representative took to administer the disciplinary meeting/dismissal was textbook, however, the content of the dismissal is in question. I have therefore lodged a complaint with the executive board and await their response. You will therefore understand that I can't really comment on the specifics until I get their reply.
On a side note, it is worth noting that the HR representative informed me that others in the company retained their jobs whilst they were bankrupt.
She also informed me that my salary would help pay off my debt with the group. After a few weeks of battling with RBS collections in Telford (CMS), they have paid my outstanding monies (earned post bankrupt staus and agreed by the OR that it was mine to keep). After many phone to RBS calls that ended abruptly, finally I asked one rep to take responsibility. Their ongoing story was that the OR should fax confirmation through to them and call after to check it was received.
After asking the OR to do this time and again (they wrote twice, then faxed once), my last call eventually broke through the lies from the RBS team and the rep came back on the line after I demanded to speak to the relevant team, and advised me that I could go to my nearest branch to collect the owed funds.
My question is why did they lie on the other calls before that?
I now have no link to RBS and am grateful for that.
I will update this as soon as I am able to do so. Thank you again for your support. It is an amazing feeling to know that real people out there understood exactly how I felt and offered helpful support when I thought that losing my job was the worst theing ever... Losing my job from RBS has made me realise that I will never have to lie again for an employer, no matter what.0 -
Thanks for the update GF sounds like you've had a hard slog to get where you are at the moment...hopefully the fight wont go on for much longer now and you at long last get the outcome you deserve

i have not joined the union and my job does not involve dealing woth any money ...0 -
It has been hard. I never anticipated that RBS would be so very hard and difficult to deal with - especially to the point of lying to me on the phone and blaming the OR instead.0
