Explain this!

Could someone please explain this for me:

"Send month 4 claim between 13th Feb 2008 and 14th Mar 2008""Instalment 1: - You will need to claim 4 months from connection and you have 30 days from this date to submit your claim. Send us the claim form and monthly bill showing your name, address, mobile number and tariff you are connected to. (This bill must be no older than 28 days when we receive it and have no balance brought forward.)"

My bank bills:
2 Nov 2007D/DORANGE - 37.67
3 Dec 2007D/DORANGE - 38.62
2 Jan 2008D/DORANGE - 40.53
4 Feb 2008D/DORANGE - 31.77

My 4th bill is dated 17th Jan (Date and tax point) which is the one paid on the 4th Feb, so is instantly more than 28 days old.

So do I send the next (5th?) bill?

  • I suggest you never take out any cashback deal unless you know how it works beforehand. Bill amounts and numbers are totally irrelevant. This sounds like E2Save or its sister sites. I suggest you do a LOT of reading on the numerous threads on here about them. You should also follow my groundrules (you plainly have not):-

    I spent quite a long while reading through all the T&C and related paperwork, but it appears I have misinterpretted these, this is why I was asking as I was unsure.

    From your wording, my intepretation is that you simply send ANY bill which is less than 28 days old in the period "13th Feb 2008 and 14th Mar 2008" to get your cashback?

  • I didn't misunderstand. Reading their paperwork is entirely misleading. The t&c are not on their paperwork - only their version of things which are quite different. Since you have waited all this time to ask you plainly can't have been reading all the relevant threads before or after you took out your contract. Ordering and studying what they send you is a huge mistake if that's all you do. As for the missed basics (apart from the aforementioned!); post one on the above thread. Make sure you understand it all before you order... don't be mislead by month numbers or bill numbers; direct debit amounts and dates are totally irrelvant; keep up to date on what's happening before and after throughout the contract; don't assume that because a dealer had a good reputation in the past it is reliable and trustworthy NOW. I could go on but it's all on the thread I bothered to write to help people avoid the basic mistakes many months ago now - including post number 5 specifically on this (and your) situation - long before it started to actually happen when the first claims under the so-called "price-match" t&c - which you are on despite your not saying that - were due). Despite the fact that you didn't state the dealer or the name of the t&c you signed up to and yet I know exactly who and what you are talking about should tell you something.

    It depends on your connection/order date. IF those dates are correct (they often aren't) and you are following THEIR way of doing things, then yes. If you follow the legal t&c you actually signed up to then you have one month from the date of the correct bill - which is not the same thing. Usually they overlap, but many times the way they do things leaves very little time to make your claim. In that case (provided you HAVE complied with the legal t&c) send a LBA when they decline the claim and then sue for ALL the cashback etc. Many on here have now followed my guidance and succeeded (though cpw still play games with them).

    Again, without you telling me I expect you took out this deal around 15th October; in which case you can easily comply with BOTH sets of t&c by sending in your February bill as soon as it arrives. If you DIDN'T take it out mid-October then those dates are completely wrong (not entriely unusual with this lot nowadays). I further presume you aren't aware of the legal t&c since those aren't the ones you are quoting - THEY came from your on-line account and (as I told you) are often intentionally wrong. These are right if my presumed connection date is correct.

    P.s. Sorry I was unclear, I studied the online T&C attached to my order. Could you point me in the direction of the legal t&c?
  • I would strongly recommend in futre that you investigate any such deal very thoroughly beforehand and copy EVERYTHING at the point of ordering. All that follows after is extremely dangerous as a guide - and usually incorrect. A great many people THINK they've followed their t&c conditions when, in fact, they didn't even have them in the first place - and/or interpreted what they did have incorrectly in all sorts of ways. I make sure the friends and family who let me order for them avoid all the traps. The price-match t&c are:-

    However, these are harder to read than originally and may not be identical. This company has a habit of changing things to suit itself after the event. If they are precisely the same (as may well be in this instance) they also conflict with the ones they are expecting you to follow (as I have explained many times elsewhere). Furthermore (and to show how repetitive this gets) someone else is asking the SAME basic questions on yet another thread right NOW - OSPS).
