TangledMemories wrote: »BAILIFFCHASER: Sorry for hi-jacking this thread...but we went to court in April last year after my Dad did a disappearing act leaving my mum with a £700 a month mortgage, 2 kids and 2 dogs.
The judge said for mum to pay £100 towards the arrears because I guaranteed that me and my OH would be paying £500 a month.
Now, because my mum is having issues with unemployment, the mortgage company has sent a letter saying they've applied for a warrant.
Does this mean we have to appear in court again or do we wait for the eviction notice?
The main reason we fell behind again was because mum's standing order was set for the 16th of the month however the mortgage company have been applying for it on the 4th.

homeworkgirl - I'm sorry your health is suffering after everything you've gone through. But the stress of this wont be helping you. *Huge hugs* and good luck

Although they are trying to go for a warrant there will be a hearing or if you recieve a warrant appeal and put a application in to the court concerned on a n224 to have it suspended. However if you have a hearing date then you must go along and explain to the judge what has happened and in the mean while the payment that was missed should be made. If you have the bank account number and sort code then you can do a payment via on line banking and give the mortgage account number as the reference for the payment. Do not worry. It is not as bad as you think. i have been along to several of these for people.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. Slight problem with that...we've missed 3 months in total. We're not fighting the repossession because my mum's sick of struggling. The house has brought nothing but stress, heartache and bad luck for the past 23 years.
Was just wondering that's all.
We've all found other places to live now...we're just waiting for the eviction notice so we know how long we have to move all our stuff.;)I am not a complete idiot - some parts are missing;)0 -
Homeworkgirl could you ask for the mortgage to be spread over a longer period of time? This should bring your mortgage repayments down and may bring them into your £500 budget.
Also like mummytofour said have you asked what benefits you are entitled to?
Hope your health gets better soon.

RE The bit in bold - If there is already a suspended possession order in place then there is no need for another hearing. The claimant can issue a warrant immediately - you can still apply for a suspension of the eviction though.Pay Debt by Xmas 16 - 0/12000

You could do something else. If you are going to let the house go then why not take another mortgage out and take the money with you. Another thing. If a warrant does eventually come through you could apply to have it revoked and live in the house until the hearing date.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. What's the chances of my mum being able to get another mortgage with arrears and a bankruptcy behind her?;)I am not a complete idiot - some parts are missing;)0 -
mummytofour wrote: »home work girl are you getting ANY help with the mortgage costs? I mean what benefits are you getting? Do you have kids?
Hi mummy, I am not certain yet whether i will be getting help towards mortgage costs as I am only just going on to benefits now that my company sick pay has ceased, but I have been told that I should qualify because my partner died and there is a special clause to protect me, I just hope this is right.

Hi M O 3, my current mortgage runs up to my retirement date already so doubt they would extend beyond that date.
£500 is not within my budget, £300 is. They have said they are not willing to consider any alterations until I have paid off the arrears but its because I am in arrears that I need the help!!!0 -
Homeworkgirl ... def take all your paperwork down to CAB ASAP. I think you now have to ring for an appointment in my local area to get seen ... it's not on a first come first served basis anymore. yell will have the number on for your nearest. I believe that benefit wise you will be entitled to Child Benefit, Child Tax Credit, Incapacity Benefit, housing benefit and Council Tax benefit. The housing benefit will pay the interest on up to £100k's worth of mortgage.
