how can they say cats are noisy, i just dont get it, i have 3 of them and all they seem to do is sleep,............ ok my youngest thinks its great fun when the post arrives and can spend up to an hour batting it around the room but thats not exactly noisy.................. one of my others has actually learnt to press the button on the tv remote so can turn that on but still no noisier than a person....... maybe your cat has an unusually high meoww ???........ TBH your neighbour sounds like an interfering old bat who has nothing better to do than annoy you.trying to lose 3 stone by end of 2014;)0

I'd just tell them to mind their own business. I can't believe for one minute any court would find against you for having a cat, and certainly not for painting your walls. Every time they starting wingeing just tell them you're too busy to talk to them.
You lease must also have a clause about quiet enjoyment? Anyway, it is your property, them being resident in the same building does not give them any extra rights.I am a Mortgage Adviser

i agree with the above your entitled some peaceful enjoyment of the property. if they keep it up I suggest reporting them for harrassment.

As has been said before your freeholder has more rights than you and the lease is law. (the freeholder doesn not have a lease as they own the property. Owning a lease is like a longterm rent paid in advance).
the groundfloor freeholder presumably has a garden? If so do you let your cat out to do it's "business" in their garden and so causing upset. (most gardeners do not like other peoples cats). If this is the problem could you not tell your neighbours that you will keep your cat in permanently. (Lots of pet owners do this). If you are not prepared to do this then I think you will have to get rid of the cat. As it is in the lease they have the law on their side. Sorry

They sound horrible - cats are not exactly very noisy! Our lease has all sorts of clauses including the window cleaning, no pets, we're not allowed to put anything on the balcony or hang washing, and we're supposed to only have carpets. Luckily the Council is the freeholder and they don't seem to be too bothered as everyone else has pets (we have 2 cats), hangs washing in their balcony and our flat had laminate flooring thorughout when we bought it. How are we supposed to clean windows on a 2nd floor flat? Buy from an ex council flat and ignore the lease!March 2016 - £178,914.59; July 2017 £146,160.38

I know someone who bought a converted flat and the vendor who owned both flats also sold on the freehold. So that leaseholder of one flat was also the freeholder. They then had a copy of the lease of the other flat. It stated that both leases had the same clauses and conditions . Anyway the leaseholders lease (in this case the OP) may say that. Therefore the other leaseholder has obligations while they are owner/leaseholder of that flat. The freehold obviously puts them in a stronger practical position , but they still must (IMO) abide by their lease.

Thanks everyone for your support. Its good to know that there are some reasonable people in the world!
As tempted as I am to buy a large dog and a cockerel I think I'll stick with the two cats and just hope that my neighbours can't be bothered to take it any further. At least there is nothing in the lease about playing loud music ...0
