    as i said in another thread - its great to have mates who can "remove the bile" from angry letters !!!

    MM - i would have written pretty well the same letter as you, and my mate Pete would have revised it and produced almost exactly what Lavender has written.

    MM I do feel for you, at least it is spring so the greenary should start growing soon.

    I have a feeling the LA will just apologise that you didn't have 24 hours notice and say they thought you had had a phone call. As this is a single breach of your enjoyment I doubt that the fact that the gardeners appeared without notice would be enough to terminate the tenancy.

    Playing devils advocate, they will say that your agreement does expect you to maintain the garden but pruning of trees and major bushes is weigh above what they expect a tenant to do, so they annually arrange for this themselves.

    It may be a question of net curtains for a few months until the spring growth appears.:(

  • I've been on the other side of the fence - so to speak. Or at least, my elderly MIL has.

    What may seem delightful trees and enhanced privacy to you can be a nightmare for neighbours. Blocking out light and views while sucking all the moisture out of THEIR garden, leylandii and similar hedging must be kept trimmed.

    Hopefully you will find another property that meets your needs and your LL will undestand your desire to end your agreement. Personally, I don't think a Court would adjudicate in your favour but, if your LL is not reasonable, this may be worth a punt.

    Is it just me that thinks it's amusing that a mortgage adviser has chosen to rent?

    GG - folks rent for a huge number of legitimate and different reasons - i am sure MM has perfectly excellent reasons ....... personal reasons !
  • I've come to this one quite late, but it does occur to me that in your letter you mention that you were 'unable to run my business as I could not hear people talking on the phone'.

    Does the LL know that you are running a business from home?

    I've only rented a couple of times, but we have always had something quite specific in the lease about using the house for residential purposes only. If you aren't certain, I'd leave this bit out. It doesn't strengthen your case, but might well go against you.

    Just to add to GG's comment - I rent because I cannot afford to buy. that simple. that and I think house prices are horrendously high and I don't want to commit myself to potential negative equity in future. Don't get me wrong I'm not a commitment phobe, I just want to do the right thing at the right time without overstretching myself and leaving my kids eating beans on toast every night.

    I think we do have a serious problem looming. The estate agency I work in has had a huge drop in business since this time last year. Where I live/work there are estate agents folding. Every day I get emails about lenders making 100's of staff redundant and "restructuring". Last week advantage lending, part of the Morgan Stanley group closed its doors to new business. Nearly everyone I know in this sector is struggling and according to RICS houses prices have now decreased for the six month running. Halifax and Nationwide reckon they have only dropped for 3/4 months though. I tend to believe the RICS survey more because they are more closely involved with every valuation than NW or HX.

    So following the credit crunch of last year and the NR catastrophe, I reckon this is a serious problem - and I think a lot of other advisers would agree with me!

    Thanks for all your help on the renting problem guys,I cut and pasted the example letter and edited it with a few more bits and bobs will post it tommorow.
