Paypal and Abbey disagreeing about refund

    "Hi there

    Further to your e-mail stating you will now no longer reimburse me for fraudulent paypal account activity leading to me incurring legitimate bank charges.

    I am disgusted at the treatment Paypal has been (not) dealing with this matter.

    You (your department as I never recieve a reply from the same person) originally stated

    "This is to confirm that the unauthorized charges on your account will be credited back
    to your PayPal account balance. Once the funds will be available, you can
    then withdraw the funds back to your personal bank account. It may take up
    to five working days for the funds to appear in your account".

    As my bank charges was the only matter that I was in discussion with Paypal about. It can only suggest that paypal were accepting their role in this fraudulent activity, and which because I had no money in my Bank Account at the time these unauthorised transactions I incurred bank charges on my account, as follows:

    My bank was correct in making these charges as Paypal had attempted to take money out without my consent. It is Paypal who is responsible for me incurring these charges and or The imaginary skype customer who defrauded my account. As stated previously, I am the sole user of this computer and I never go online anywhere else. No one at all has access to my passwords and all passwords for differerent sites are individual and personalized to that particular site. Obviously my information has been passed on for this fraud to occur. I don't understand how you can say oh yes there has been a mistake and we will refund the money which has been illegaly taken from my account, but you can not reimburse me for charges incurred because of this fraud. I have sought legal advice regarding this matter and they agree that I have a solid and legitimate case, in only 1 e-mail could you please provide a full disclosure of the fraudulent activity upon my account, the investigations and results of your findings on this fraud and the full account and business holdings of the Skype customer who was to benefit from my money had funds been available. I then can begin a legal prosecution with regard to the fraud and if not compensated then, a civil action thereafter.

    you need to inform the ombudsman NOW just take a look on the ebay board onn this site to hear how much trouble paypal causes for people.

    this time last year they kept £500 id made selling my own thigs so i could buy my kids decent xmas presents. They refused to pay it back till i could prove there the things i sold cam from despite them being 2nd hand. The ombudsman managed to get my money back without going to court. They are lovely people who do not use jargon on you and keep you informed every step of the way.

    But since PayPal are based in Luxemburg they can just ignore what the ombudsman says and you have no legal comeback.
    Not so. They are a financial institution offering services to UK customers.

    I have taken this directly from their site, so they simply cant ignore UK law.

    No. PayPal Luxembourg will be regulated to the same standard as all major European banks. Banking laws and standards in the European Union ensure that customers are just as protected by a Luxembourg bank as by a UK, French, or German bank. Regardless of where you live in the European Union, you will still be able to address disputes through the UK Financial Ombudsman Service if you are unable to resolve them directly with PayPal.

    I am having the same problem. I went to the cash machine, only to be told to contact my card issuer. I called Abbey, and they told me I had insufficient funds in my account. This was impossible - I had only just been paid and I KNEW I had funds in the account. Or at least I thought I did!! After being placed on hold a number of times and a call lasting over 40 minutes, they tell me that a number of large purchases had been made thru PAYPAL just hours before. These transactions have totalled £1006.22. I was told there is nothing they can do and I would need to call their fraud department (open 9-5) I logged onto my PAYPAL account to find that I have limited access. 4 cases are open and are being looked into.

    Today I have spoken to Abbey fraud department and spoke to a terribly RUDE man who was eating during the entire call and kept telling me to "hold on" with no explaination to what he was doing. He came back with - There's nothing we can do for you I'm afraid. I asked him what I should do now....? And he told me that it was up to me really, as he couldn't physically do anything for me apart send me out some forms to fill in and getting the money back was not guaranteed, and would take 3-4 weeks to investigate.

    I have contacted paypal on 08707307191 and spoke to someone there and she has told me that I am 100% guaranteed a FULL refund of all transactions, but will take between 10-14 days.

    I am left with an empty, overdrawn account with bills to pay.

    I am now worried about the charges Abbey are going to incur - It seems from reading the previous posts here that Banks are going to do anything they can to not accept responsibility for them.

    We'll see.

    Good luck, still awaiting full details of the fraud from paypal for my problem, before further attempting to be compensated for the charges I have incurred.

  • I had 8 transactions from Skype in one night on my paypal account. Fortunately I saw the emails straight away so cancelled my DD, so paypal couldn't take the money, then I reported it.

    Paypal admitted liability but say as soon as I reinstate a card/DD they will deduct the amounts and then refund as they are fraudulent!!! I have closed my paypal account now.

    Sounds like the same scam that I have endured, well done for spottting the transactions and for stopping your DD. My paypal account will also be closed and never to be used again if I ever sort out this mess.
