  • IIWY I'd get some legal advice to see if you can carry on paying the mortgage and stop the repossession.
    I'd re-think your finances ie. £60 for mobiles plus landline per month is a lot and your mobiles could be cheaper changed to PAYG. and you could also claim bank charges back to claw some money back to pay off the mortgage . Could your OH consider doing extra work as a mobile mechanic to up your income. Like the previous poster said have you claimed critical illness for your husband off your insurance.
    CAB are good at helping you to contact debtors to arrange a voluntary arrangement for payments until you can manage them better.

    I know it's not means tested...but do you know how difficult it is trying to convince those happy people at DWP that you can be 28, have all your limbs in tact, work 35 hours a week and still be disabled?!

    Brick wall and head banging spring to mind!
    I dont feel like there's any support in my area...don't know where to turn

    Actually, yes, I do!!

    Its a notoriously hard benefit to be awarded and my best advice is to either go to CAB or a benefits welfare officer to help you complete the forms.

  • I'm trying to fill in the Disability application forms but they're so difficult. There's a company near us called WYAC who apparently help you fill in the forms and fight the DWP on your behalf...but the times they want us to attend we can't just walk out of work for!
    Try the CAB/support organisations but it probably is worth taking a day off to do it if necessary. Often you need a key benefit/allowance to access other care and for mortgage companies/banks to accept it's real. You have to give them the info. to be able to help you and fit in with safeguards to mena services aren't abused - try and think of the rules and obstacles designed to ringfence protections for people who actually need them.

    SO where is January's mortgage payment now? Has it been paid along with the £100 arrears payment? If not you need to pay as much of it as you can now. Get a receipt for it (presuming your going to go into the bank and pay it over the counter).

    Then you need to go to court and show the judge the receipt and your bank statement showing that the lender attempted to take the payment earlier than the court agreed date and the resulting bank charges. Hopefully the judge will see that the delay in payment was not your fault and not grant the possession order.

    I didn't say DLA was means tested, but it's a passport benefit which makes getting the WTC easier - which is fixed to 16 hours plus.

    Ahhhh ~ I misread your post :doh: (I read it as he can work 16 hours and keep his DLA rather than working 16 hours to claim WTC's IFSWIM)

    Thanks for the advice...I know our mobile bills are high...but I need my mobile for work and the landline is needed for the broadband which is also needed for work. They're down as low as possible cos they're on 18 month contracts and cant be changed yet.

    My partner cant work any more than he already does without burning out because of his illness and we cant claim anything because the insurance policy doesnt cover this illness only anything not directly relating to the PA.

    Today, we went to the courts and discussed with them the options. When the warrant goes through, we are going to apply for an extension to give us more time to move. In the meantime, I'm looking at a property tomorrow which will cost less than £500 a month and will give us our lives back. My mum can't deal with the hassle of the house and already has somewhere to live in the Isle of Man so we're not going to fight anymore.

    The house has brought nothing but bad luck and misery in the 23 years we've had it. Yeah, there's a stigma to repossession, but I've got more important things to worry about than a mortgage that isnt even in my name.

    You'll probably all think I'm stupid...but if I can save money on housing, it means more money off the debts and in turn we could get our own mortgage that we know we can afford.

    Sound like a sound decision. You really do not need all her stuff, when you have quite enough yourselves. Get on an even keel and then sort the DLA.
