    I know what you're saying about the mortgage thing...but mum has been paying it. The mortgage people have been trying to take the money on the 7th of the month instead of the 17th which was arranged with the judge last time. Therefore last month's couldn't go through.

    No letters have been received other than the one yesterday informing us they've gone straight to court.
    ;)I am not a complete idiot - some parts are missing;)


  • Surely if the judge says the payment has to go on 17th then they haven't got a leg to stand on, are the payments behind?

    Something just popped out to me & that was the insurance you are paying for critical illness, is this something you could claim on at all??
    Surely after you have helped your Mum out, she could help you out a bit by fighting to keep the house, at least for a while until you can find somewhere else??

    If you've already seen a judge once, I'm guessing that the mortgage company have taken you to court previously and the judge awarded a suspended possession order. This means that provided you keep to the repayments agreed with the judge, the lender can't repossess.

    The downside is that, if you miss any agreed repayment, possession is likely to be awarded.

    The agreed repayments would include an amount to pay off the arrears, resulting in higher repayments. Have these payments been met in full?

    Something is missing here. Either the new repayments have been made on time and in full and so the lender would not attempt a repossession as this would breach the suspended order agreed with the judge, or the repayments haven't been made in full and on time and so the lender is going back to court.

    If the mortgage is in your Mum's name she probably has all the information and you need to check with her the agreement for paying off the arrears.

  • I was sat in the court room. The mortgage is £720 a month with an extra £100 for arrears.

    The only month that was missed was January because they messed about applying for the money from the bank and it ended up being swallowed up in charges.

    At the end of the day I have to face facts...we need to find somewhere to live and fast. And then I've got to somehow move all the furniture.

    Just thought, if your OH can do some work and can work 16 hours and gets awarded DLA, he'll be able to get Working Tax Credit which would help a lot. He then needn't work so hard he gets ill but can still contribute.

  • Yeah but we need that £1000 a month to survive. Can't survive on DLA and Working Tax Credit.

    Plus being a mechanic for 16 hours a week - there's not much point in turning up....


    Looks like I'll be taking painkillers to enable sleep again tonight.

    DLA is NOT means tested ~ if he qualifies he can work 116 hours a week if he wants and it wont be affected.

  • I know it's not means tested...but do you know how difficult it is trying to convince those happy people at DWP that you can be 28, have all your limbs in tact, work 35 hours a week and still be disabled?!

    Brick wall and head banging spring to mind!
    I dont feel like there's any support in my area...don't know where to turn
