If you love your house and have no intention of leaving not a problem. Very lmited knowledge of this as I rent and if I am wrong someone please correct me.
You will not lose your house though. Dont worry.

A charging order just secures the debt on the property. Only a problem if you try to refinance your house or move you will have to pay them off before you do anything else.
If you are on a DMP judges tend to just rubber stamp the amount offered so they are really wasting courts time. I think I read somewhere recently on the main board where someone turned up to court and defended themselves against a charging order and won - unless I have been having strange finance dreams.
So YM is right.0 -
Spot on Andy and Hi Sparkly :hello:

Just had a calll from Northern Rock to advise me that it is not their "policy" to accept reduced payments and they will "have to go for CCJ" as apparently "that is the only way to reduce interest" Yeah right! What a load of B*****T!!!yellowmonkey wrote: »Northern Rock are a joke. Pot and kettle spring to mind. Who are they to tell people about controlling their finances when they cannot run there own.
Hi loopylu & YM
Northern Rock hey, I have a thread running on here re contacting someone high up at Northern Rock re their continuous harassment.
I have read somewhere it is against OFT guidelines for creditors to refuse to negotiate through third party appointed representatives, perhaps someone can supply the correct paragraph.
Some of these call centre staff, haven't got a clue what they are on about.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -

Thanks YM and RD, for the reassurances. Although I know what a charging order is and how it sits on the property etc and with my sensible head on I know I don't really need to worry too much as we have no plans to move before DMP is finished. It's just that I then get into "panic" mode and convince myself that they will force me to sell or join forces with other creditors etc, and you know what it's like, you convince yourself that the absolute worst is going to happen. I did speak to CCCS who said this is "highly unlikely". Anyway, I've been off and had a good cry about the "unfairness" of it all, which of course it isn;t - it's all my own fault. I just feel so guilty as I really beleive that it IS all my fault (even tho debts are joint). I always said I didn't understand people who got suicidal over money, but for a moment there this afternoon, I just really really wanted it to all go away. I guess I thought it was going to be easy - we were offering a decent sum so creditors would just say "yep - no problem" and today it really hit home, that I'm actually not taking the easy way out (in many wasy to have carried on as before would have easier).
But I'm British so stiff upper lip is now firmly re-stiffened:D and I WILL DEAL WITH THIS!. No one has died and if I lose my house (which I won't) I will still have all my possessions (which are what make my house a home) and my lovely DH and DS. They really are the important things in life.0 -

Thanks, I have seen that thread and I'm minded to write to that man whose name escapes me at the moment. I'm also going to request my CCA from NR cos I know I signed one! But let's just hope that they didn't keep it! I will fight the CO if i get the chance - out of principal if nothing else. If you take an "unsecured loan" they shouldn't be allowed to "secure" it and threaten your house in the process. I understand if they were dealing with someone evasive but if you are ready and willing to repay them, it's bang out of order! IMO anyway!0 -
You won't loose your home but you are low at the moment and feel that it is threatened - other peoples problems are always easier than our own to deal with and we can always see ways out for people.
Credit does feel the easy way out but one day someone pulls that rug from under you and it could be way down the line when you have secured loans on your property you can't afford - then your home is at risk.
Unsecured debt does not risk your property and you have been responsible and I am sure by the end of the week you will see it until then you give DH and DS lots of hugs and they will pull you through this low patch.
Take care!
PS Just a light hearted DMP moment - last week I did a review of my self managed DMP and one company went up from about £1.58 to £4.13 (they had been getting £1.58 for a whole 2 years!) apparently they will in huge block letters ACCEPT THIS EXTREMLY LOW AMOUNT FOR A VERY SHORT TIME - made me chuckle anyway!
Sods law DMP moment - I didn't raise one companys payments and they wrote today to ask for more money!0
