O2 Upgrade/Charging Problem

I wonder if anyone is able to give me any advice?

Around the 12th Jan I upgraded my O2 contract and phone, I upgraded to a £30 a month contract and ordered the LG Viewty. A couple of days later I was charged £39.99 for the phone. I had the phone a week and didn't really like it so I sent it back then ordered a different phone which was free of charge. I emailed O2 asking when to expect my refund of £39.99 and was told between 21-28 days. Fair enough.

This morning I have just checked my bank account and have had £91 taken out of my account by O2. This appears to be made up of my contract charge being £30, a £20 charge for internet browsing which I disagree with in itself but also a £39.99 charge relating to the order of my LG Viewty. I have therefore come to the assumption that they have charged me twice for the phone which I know longer have.

This £91 has now taken me overdrawn, I am a student and have other bills to pay and cannot afford to get more and more overdrawn while waiting for my refund from O2.

I intend to call and ask them whats going on, I am expecting a refund but can I threaten them with anything if they do not pay within a certain timescale? I can't afford to wait a month for my refund, does anyone have any suggestions of how I can work it in my favour?
