Car Inccident please help...

Hello,

A friend of mine was involved in an incident. He reversed into a car accidently ofcourse. At the time there was no body in the car as the owner was inside her house. She saw what happened and she came out quickly confronting my friend.

Her car should have not been parked where she had parked "as the road is clearly marked", and the inccident was completley an accident because it happened so fast.

My friend is on a comphrehensive insurance. I was a witness when all this happened.
Now my friend has received a letter from his insurance company asking for details to the inccident.

This inccidnet happened around mid October 2007 the lady of the hit car didn`t report it untill the 29th of January 2008 (after 4 months)

What do you advice my friend to do?

P.S I have attached a sketch (if not) ..of the scene.

Can't really see what else he can do apart from take it on the chin, after all he did hit a stationary vehicle. Put it down to experience and try to take more care next time

The picture doesn't make a difference. He hit a parked vehicle. Cannot be anyone elses fault but his, irrespective of whether the car was parked legally or not.

    Ooppsss Ok..
  • had the object been left on the road either unlawfully or in an unsafe way, for example, a car parked on a blind corner. If so, the owner of the object or vehicle may be liable

It doesn't matter, it's still his fault and he is liable. I've been in a similar situation to your friend and it was still my fault, regardless of the bad parking of the other person.

    I believe this is accurate.
You have a "duty of care" even if the other person has been really stupid with their parking.
If he/she couldn't get out safely they should have tried to find the owner and asked them to move it. In this case knocking on nearby flats is recommended, otherwise call the police and they will find the owner via DVLA and try to contact them (but not necessarily immediately).

What if it wasn't a car parked illegally, but a kid or a mum pushing a pram along the pavement. ??
He should have looked behind him properly and slowed down. (Incidentally I once drove into the back of a stationary bus!! I accepted liability thou as I obviously wasn't paying attention )

Your friend has simply got to put their hands up and say "fair enough, I was at fault", and get this over with as quickly as possible and move on. The car was parked where it shouldn't have been but if it made his manouver tricky then he could have asked for it to be moved. Perhaps your friend could think about no claims protection next time, (maybe he has it). It saved us a fortune this year when my wife reversed into our house
  • So this law on stationary vehicle dosen`t apply by the looks of things:
*had the object been left on the road either unlawfully or in an unsafe way, for example, a car parked on a blind corner. If so, the owner of the object or vehicle may be liable

Thanks for all your replies even though I have no good news to give my friend :(
