Is this enough reason to be able to cancel contract

Hello,
I took out an orange contract about 6-7 weeks ago.
When i got the phone orange somehow managed to attach it to my brothers account and bill him. He refused to pay the bill of course.
I been trying to sort it out for 6 weeks, and even got cpw to re-send them the contract. Now they have my details and are still insisting my brother has to pay for the first 2 months.
Anyway they have cut the phones off now as we have refused to pay until its sorted.
I asked to cancel as they are in breach of data protection etc for attaching the phone to my brothers account without going through security, and his name never being mentiond during the sim registration.

Orange at first agreed to this on two seperate occasions, then when I called for progress they said they had no record of this and I am liable for all charges from the begining of the contract.

Am i in my rights to cancel this contract because of all these problems?

    Getting out of an Orange contract is hard when they have breached it.

    Your experiences are poor admin, but not breaches so great they allow you to cancel.

    Complain bitterly to their top man and hopefully a tangible goodwill gesture will come along.
  • yes i was informed of that but it does break the Sales of goods act, and data protections act. I can't even speak to them at the moment as they have cut the phone off.
    I sent a second letter of complaint on friday.

    Have you seen those things, often red, often found in High Streets, often called Public Telephone boxes?

    07973 100 150 (from any phone) will take you through to CS

    very odd, your brothers number must have been given at some point im guessing? dont know how cpw work but way i would do a contract it would be very difficult to connect under the wrong name unless
    the brothers number was given (even then names and details would have to match)
    it went through to referals who said that there was already an account at that address under xyz and sales person would say yes or no its them whether it is related to the customer or not

    however the problem occured i would ignore CS, and go to head office with a letter of complaint, they usually have to get a response form the store asap, or speak to the store to resolve as they issue is likely to have occured because of their convo with CS
