When the OP sells the house, she'll need to declare if there are any disputes with neighbours.
I wish I could see a picture of the fence. It must be something really special. One day the OP might have a real problem that will put some sticks into perspective. For crying out loud, grow up!

i had the worse 3 years of my life with nextdoor building a porch on the front of my house and a two storey extension on my back.i have had to take legal action and have an expert in to take them to court.has you have to have an experts report for the court to see if you are right.stick a notice on the fence stating that its your property and that you will take legal action,,then take a picture of this,,then you can call the police if its been removed on a criminal damage charge..if you had a cctv that would be even better.i know what you are going through,i myself have the final hearing in may.i have suffered ill health and depression over it all...just for them to make money on my back..i have no partner so its all on my back...i feel for you.0

My neighbour has planning permission for an extension. I objected to his extension and stated that under no circumstances could he take down the fence. As I left for work this morning, he handed me a builders business card and said his builder is starting work today, and will be taking down the fence. Does anyone have any advice? I've phoned the number on the builders card loads of times and it just goes to answerphone.

My advice - Chill - Life is REALLY too short.
Get them to agree to make good any damage - save the stress and hassle - and the possible law suite against you if you ever decide to move and don't disclose a 'neighbours dispute'.

If the neighbour gets arsy, just put up a 6ft fence 1 inch on your side of the boundard fence. Then set a camcorder. then hand the tapes to the police.
You could put a fence up of 6'5.6" on your boundary! You're allowed a 2 metre fence under General Permitted Development Rights if its not bounding onto a highway. It you're gonna build a fence to annoy your neighbour might as well build right up to the limit!0 -
Also, when the planning permission was granted have you looked at the application since? The conditions may state that the fence may not be removed or something similar. Your Local Planning Authority can issue a Breach of Condition notice if so in order to get them to comply. I'm fairly sure if you don't comply you can be fined up to £20k (that may be for a Stop Notice...can't remember it all!).
But in essence if permission is granted to remove your fence and put it back in, you can't appeal against that! Its only ever an applicant that can appeal against refusal or non-determination.0 -
