Selling up, do we have to mention neighbour trouble?

We bought our flat a year ago and were the lucky recipients of an alcoholic downstairs neighbour with laminate flooring and a half dozen toerags who troop in and out as they see fit.

I'm no Hyacinth Bucket but seeing the state of these "people" was a real eye opener!

We eventually got a noise abatement notice served which made no difference. The police have proved to be useless and chat to him on first name terms.

We eventually decided to move out into MIL's dining room and put our flat up for sale.

Legally what do we have to tell the estate agents and prospective buyers?

Any help greatly appreciated.

  • Legally no, at this point, but the buyers solicitor will send forms to you including questions about neighbour disputes so it will come out sooner or later.
  • I moved into my house last year and I wasn't told what the cretins next door were like. I was up at 4am this morning to the sound of their ridiculous 'dogs' yapping away. I've been round to ask them to keep the noise down before, all sweetness and light to my face and then drunkenly shouting abuse through the walls straight after.

    So sorry for hijacking your thread, but how did you manage to get the Noise Abatement Notice?? I'm going to have to take things further with them, I'm on my third sleepless night in a row.

    We were part of the 101 trial so initially we tried them, who in turn passed it onto the local council but you could contact your council direct.

    They bring noise recording equipment to your home and leave it there, normally for one week, then let you know if the noise is classed as excessive.

    We had to have the equipment three times as the first time they warn him, the next they write to him again and the after the third time he was served with the noise abatement notice.

    The problem is now we are expected to have the equipment out each time he breaks the notice to add more evidence to the court case. I just don't know how long are we expected to live like this. The system seems to have failed us.

    The problem with making an official complaints is that it will come to light when you sell the house.. Sadly the best thing to do is to keep it off the record, otherwise you might find it difficult to sell.

    Blimey! you're trying to selling a flat bought a year ago with a neighbour dispute, laminate flooring and ongoing drunkeness.

    Meant to add you need to keep a diary too the council will ask for that first for evidence.

    I suppose it depends how much you are prepared to put up with, I'm one of those people who can't bear injustice and the fact that we're in effect paying for im to be a drunken @rse downstairs meant that I had to try and take action of some sort.

    I presume that's on the solicitors property information form where your legally obliged to declare it.

    I don't think it comes up on any kind of council searches.

    If someone did lie on the form what are the consequences ?

    You can probably sue the seller but on what basis ? and I wonder how difficult it would be to get any form of compensation?

    btw - I'm not saying lie on the form just wondering what are the consequences ?.
