quick question about fencing...

    Not all boundaries are the same - for example on our side of the road we are responsible for the boundary on the left looking down the garden and on the other side of the road they are responsible for the right.

    We are 95% certain our house deeds stipulate that we are responsible for fencing to the left side of the garden, and this property is on the right of us. If we are correct in this (going to dig out our deeds tomorrow) can we request that the new owner repairs the fence at his cost?

    Im assuming that the answer will be no and the only way around it will be to erect a fence on our side of the boundary but I thought I'd check :D

    I would only erect a fence on our side of a boundary as a last resort - if only because it can lead to a lot of problems further down the line for subsequent property owners. - And if I were a buyer this would put me off, especially as the neighbours would be tenants and not the owners.

    Your deeds may also stipulate what type of boundary can be erected. Can't remember word for word what our deeds say but for example ours state a substantial barrier has to be erected AND maintained (which rules out wire strands etc.)

    Have you asked the owners about the fence yet? You might be able to quote the need for a substantial fence. If they are still reluctant suggest splitting the cost, and if they still won't pay ask them if you can put the fence up at your expense but on the correct boundary. - And get it all in writing.

    OH is going to approach the owners today I think. We cant put a fence up on our side really as we simply cant afford the costs.

    I'm a little concerned as I have 2 small terriers that are safely enclosed in the bottom part of the garden, but its worrying me if the new tenants have a dog its going to be able to wander into mine, and possibly get to my own dogs.

    We will be nice and polite and see what they say in the first instance :D
