quick question about fencing...

Our next door neighbour (not the attatched side of us!) moved out and sold his home at the end of last year. A developer bought it and has spent a few weeks remodeling and the house is now up to let.
Our back gardens are huge, and as the old man was an alcoholic he left his garden badly neglected. Most of his poorly erected fence was blown down in the winds last year and not repaired.
We are 95% certain our house deeds stipulate that we are responsible for fencing to the left side of the garden, and this property is on the right of us. If we are correct in this (going to dig out our deeds tomorrow) can we request that the new owner repairs the fence at his cost?
Im assuming that the answer will be no and the only way around it will be to erect a fence on our side of the boundary but I thought I'd check

That's it. Put your own one up.
If they've just done the house up and left the fence, they couldn't care less. No harm in asking them though!Everything that is supposed to be in heaven is already here on earth.

Yep, thought as much. Thing is we are currently up for sale, and the cost of 200ft of fencing I could do without
It made me smile though, the rental on the place is more than my mortgage and according to the builder who left last week the house still stinks to high heaven (long story!)0 -

as I said, he and his wife were alcoholics who never cleaned or washed and kept a dog and a cat. Neither animal left the house and neither of them cleaned up...
Anyway, wife died in June. she was dead on the sofa for 2 days before he was sober enough to realise... He carried on in the house until beginning of December but then took a council property and the house was sold.
The first day the builders came I was there as they all ran out into the front garden heavingWas rather amusing I have to say!

Yep, thats how our's are. I don't know whether this applies to all, but according to OH its in the deeds that we are "responsible" for that side.0 -

Yeeees. Shame though, when we first bought this house almost 12 years ago they were a normal middle aged couple who went to the pub on a sunday. They turned into a pair of raving loonies over the last 4 years0 -

To be fair they had always liked a drink, then he lost his job followed by her 6 months later and that was the beginning of the end.
For the last 6 months they were here they were a nightmare. Bear in mind they arent the ones attatched to us, but we could hear them screaming and yelling at eachother all night. They were abusive to everyone, shouting at me for washing my car on a sunday afternoon etc
The night she is thought to have died the screaming stopped about 2am and I jokingly said to OH "he's probably killed her"As it turned out, she had died from chronic alcoholism and he had passed out. Only when the son turned up 2 days later did anyone know she was dead.
All rather tragic really. When our kids were little they used to go round there for a game of chess with the man. They were nice people. It was quite sad to watch them fall apart.0
