Reclaim Stamp Duty

Has anyone ever heard martin talk about reclaiming stamp duty ??

I did it a few years ago and claimed back £870. I paid this amount of Stamp Duty for an £87,000 mortgage but then I found out that the area I was living in was classed as disadvantaged. So I checked this out at http://www.hmrc.gov.uk/so/dar/index.htm and it was confirmed. All i had to do was write to the Land Registry and pint it out and make a claim. Simple !

Let me know if anyone else has achieved this.

PS. I seem to remember a two year cut off period between moving into the property and making a cliam so be quick !

    I claimed my stamp duty back for the same reason as you, £850 claimed, back, but this was about 4 1/2 years ago. I purchased my house in 2002 and found about this about 18 months after I purchased property, I got the solicitor who I used to purchase the house to do all the work and I made £15 interest as well.

    At least you know you are not alone.

    There was a thread on here a couple of weeks ago about reclaiming stamp duty. I claimed it back, with interest, as myself, the solicitor & Inland Revenue didn't realise the property was in a disadvantaged area. They all work of the post code, when it is actually the electoral ward that decides if it is a disadvantaged area.

    am trying to find out how far you can claim from? was there a set date from when this scheme was introduced, my house was purchased back in 1990 and am wondering if i can still make a claim?

    It came into effect about 7-8 years ago & I don't believe you can apply for properties purchased before the scheme was introduced.

    Transactions undertaken before 17 March 2005

    For transactions where the effective date was between 1 December 2003 and 16 March 2005 (inclusive), disadvantaged areas relief was available for residential transactions on the same basis as for transactions since then.
    In addition, unlimited relief was available for transactions involving non-residential (commercial) property situated in qualifying areas.
    Relief is also available under transitional provisions for non-residential transactions where
    • a contract was entered into and substantially performed on or before 16 March 2005, or
    • a contract was entered into on or before 16 March 2005 and completed or substantially performed after that date, provided that there is no variation or assignment of the contract or sub-sale of the property after 16 March 2005 and that the transaction is not in consequence of the exercise after 16 March 2005 of an option or right of pre-emption.
    The Birmingham Stamp Office can give further advice about whether a transaction falls within the transitional rules. If you wish to claim non-residential disadvantaged areas relief under the transitional provisions, please send your land transaction return to the Birmingham Stamp Office, not to the usual address (correspondence to be marked with DAR query).

    I take it this effectively saids we can not claim anything?
