I’m hoping someone will be able to offer some help or advice. Basically I have been with vodofone firstly with carphone warehouse and then with voda directly when they took it all back from cpw.

Unfortunately I’m a bit of a phone geek and I always upgrade as soon as possible and so I never ever take out 18 months contracts.

I have one account but with 2 contracts and a regular payment for a paygo all linked on the same account.

I upgraded last year when the N95 was released and then again in October for the other contract so I was expecting to be able to upgrade fairly soon on one the contracts.

With N95 I contacted them for an upgrade and was told I couldn’t have the handset free on the existing tariff and would have to pay (I think around £150) so I refused. I then requested my PAC code and a day or so later get a call asking why I have requested it. When I explain that a number of dealers are offering the handset either free or with psp or xbox and so why should I stay end of conversation really. So another day or two pass then I get a text saying if you still want an N95 we can offer it you for free so I call and arrange the upgrade.

Both times it wasn’t until I received the handsets that I realised they had upgraded me onto 18 month contracts and I have then had to contact them to change it 12 months.

I contacted them yesterday to find out when I could upgrade and was told it was August for both contracts so I basically told the person I spoke to that both contracts should only be for 12 months. She agreed that she can see where I have contacted for the contract in October but not for the previous one. I told her that I had definitely contacted them and changed the contract duration because I never have 18 months contracts but she just advised me to check my paperwork.

I know I definitely changed it because I had the date wrote down for when I would need to return the handset if the revised paperwork had not arrived. I even kept the phone boxed and in the office with a receipt I’d made out for the courier to sign if I needed to return it. The paperwork arrived a couple of days after I called them and so everything sorted.

I tore the house apart but now can’t find the paperwork and it seems it’s a case of my word against theirs.

Can anybody offer any advice?
