Ripped Off On Cash Back Offer

I rather rashly signed up for a 12 months free phone from e2save.
A total of £420 cashback is due to me.
According to the terms and conditions I needed to send in the bill “that arrives showing you have been connected for four months i.e. if you were connected on the 1st of January, you need to send in the bill that is dated around the 1st of May. This is 120 days (4months) after connection.”

I was connected on the 14/8/07. 120 days after this is 13 December. Sending in the bill dated 20/11/07 would not show I had been connected for four months so I waited for my December bill. This didn’t arrive until the New Year, perhaps due to the xmas post. But there was no need to worry as I still had 30 days from 21 December, or at worst 13 December (my 120 day anniversary). When the bill arrived I sent it first class recorded and it was signed for on 8th Jan still within 5 days of the worst event cutoff.

However, like many others here, I have been informed that the claim for this cashback and all future ones that were due, have been rejected and I am no longer eligible for any reimbursement.


I plan to write to them and then start small claims proceedings after a fortnight. Has anyone any pertinent advice?

Im so !!!!ed off. It may take more than £420 worth of effort and I may not get my money, but they should be allowed to get away with this.

    Hi,

    Go to the E2Save website and log into 'Your Account' at the top of the page, log in then click on 'Offer'. This will give you a breakdown of your claim dates, I've copied and pasted my claim dates below to give you an idea of the information that is available. From what you have said you have claimed at the right time. Print off your claim dates and initially send a copy of your Recorded Delivery slip and I'd also print out the confirmation of delivery off the RM website. Send everything Special Delivery with a covering letter basically advising E2Save that if you don't get a satisfactory response you will pursue your cash back through Money Claim Online and I'm sure you will get the response you are looking for.

    Post 31. Post 5 describes what has happened. The dates on your account will either be wrong by all sets of t&c or correct by theirs and wrong by the legal t&c. This is precisely the thing I expected months ago, before the first claims under any price-match deals were even due. Your facts are absolutely correct. They have not only broken but ignored the legal t&c. Whatever dates are on your on-line account are irrelvant. LBA then sue.
  • I have double checked and the claim dates on my account are the same as the specific 'Price Match' T&C's. My first claim date is 4 months after I was connected.

    Connected on the 18th November, my billing date is the 20th of each month and my first claim date is from the 18th March. I should receive my March bill around the 23rd March (4 months after connection).

    £201 to £600 claims
    Cash backs are claimed in five equal instalments.
    Instalment 1: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, that arrives showing you have been connected for 4 months. i.e.
    if you were connected on the 1st of January, you need to send in the bill that is dated around the 1st of May. This is 120 days (4 months) after connection. See porting below
    Instalment 2: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, dated 180 days (6 months) after connection.
    Instalment 3: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, dated 240 days (8 months) after connection.
    Instalment 4: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, dated 300 days (10 months) after connection.
    Instalment 5: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, dated 360 days (12 months) after connection.
