Hello anyone.
Someone provided this link to a letter that i am to send after 12+2+30 http://forums.moneysavingexpert.com/showpost.html?p=6582439&postcount=36
Do i once again need to send this to Bcw AND Aktive Kapital? If so, then do i make all fererences in the letter to "Aktive Kapital" Or do i just quite litterally send them a copy of whta i send BCW????

I have sent the letters to both BCW and AKtiv and recieved a letter that suggests that they are going ahead and chasing this debt anyway.
On 21st July I Sent the 2+12+30 letter (To both) and Have today recieved a letter from BCW confirming that they have recieved the letter and sending a copy of their response to the original CCA letter; Which states:"I would advise that we do not hold copy credit agreements at this office, as we are not the creditor."
"I would advise that we have placed this account on hold and have asked our client to forward the documents to you directly"In the latest letter, they then go on to confirm, that request was made to obtain the documents from the client, £1 postal order returned to me and above letter sent to me.
It then says:"The actions of bcwgroup plc will have an adverse affect on your credit rating. As such any defaults placed on your file will have been done by our client Aktiv kapital."
"I have again made a request to obtain the neccessary documents. A cessation of collection activity has been placed on authorised Whilst I await a response form our client."
I find all this really confusing but in the 2+12+30 letter that i sent it states:[FONT=Arial, sans-serif]"If the creditor under an agreement fails to comply with subsection (1) -
(a) He is not entitled, while the default continues, to enforce the agreement; and
(b) If the default continues for one month he commits an offence."[/FONT]
So doesn't that mean that they cant re-apply for the documents because they already failed to provide them???? :eek:0 -

That says to me that they are not going to chase you until they get the CCA through.
At least, that is how it reads to me.
Not sure if they will keep to that, but legally they should.
Sounds like neither they or Aktiv can find anything. :;)
That section of the Consumer Credit act from the letter you sent basically says that they shouldn't try to collect on the account, until they comply fully with the CCA request. Have you checked your credit file to see if this debt is on it?
You can check for free at experian (if you cancel within 30 days).
If you are sure this debt is not yours then it shouldn't be there. I would check just to make sure there isn't a default or anything on your file from it.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
