... I have been getting missed calls from an 0845 No: that i have not been ale to answer cause i'm in work but they reing at least twice a day EVER day.
I just googled the number and its BCW group. (Precumably the same company that i jus had this letter trom)

Not to aktive no. Just to the company that were requesting the money on their behalf, they returned my letter to me with my £1 fee advising that they were passing it back to aktive. Then as adv by RAS sent onother 12+2+30 days later (I think on the 15.03.08) informing them they had entered default. I never heard anything after that. Now i rec'd this letter from BCW(?)

Yep. I saw that.
The reason I ask is that Debt Managers should have passed your request for the CCA on to Aktiv, rather than just returning it to you and washing their hands of it.
So at the moment it is hard for you to claim that Aktiv have passed on an account that is in dispute, because the dispute has never been formally raised with them. If you complain then they will deny all knowledge of the account being in dispute.
If you had sent a request to Aktiv, then you could have sent the letter here to BC&W.

Well i still have the letter from DMD stating that they were returning it.
Ths things is, I couldn't get any contact details for Aktiv from DMD.
So i need to start all over again? Resend the CCA letter to BCW? (They're sly F**kers!!). How do i find out where to send it to Aktiv then?0 -

Officially you should only have to send a CCA to BC&W. But you have seen what can happen with that.:rolleyes:
If you send to both, then they can't wiggle out of it whichever way they jump.

Make sure that you give all the reference numbers from BC&W, plus enough other details so that Aktiv cannot claim that they "can't find details of the account".
I would also be inclined to add to the BC&W letter.
"If you are acting on behalf of another creditor or collection agent, then it is your legal duty under the Consumer Credit Act 1974 to pass this request onto that creditor or agent so that you can obtain the documents requested. On reflection I don't think I would mention it in the BC&W request.
