No fault accident other driver won't give details - please help!!

Hello,
It often takes months if not years to settle cases.
Sometimes there are on-going injuries involves and often people want to argue about whose fault it was.
In you case it's fairly obvious whose liable AND the car is driveable.
In a lot of cases people can't wait months or years for it to be settled before getting their car back on the road, so the way it works is that you make a claim on your own insurance, then in the fullness of time they claim the money back from the other party.
They can't guarantee they will be sucessful because some people aren't insured or some companies might argue about the details.
In your case there is no reason to thing it wont get settled but clearly you won't get anyone to give you a guarantee.
It does take time I'm afraid.
I would recommend that you both put a pen and paper in your dashboard and a disposable camera (if you don't have a phone camera).
Always try to get an independent witness.
She might be OK in this case but a lot of time people will dispute the facts.
Also I would say don't stalk the other party.
It's not the done thing.
In his posistion I would be quite worried about the boyfriend knowing where I live and to be honest I'm not suprised he's screening your calls.
What you are doing could be described as harrassement.
This really should be left to the insurers.
If I were the 3rd party who has openly admnitted to his mistake I would be quite concerned about direct approaches.
Also don't push him to admit liability. It can invalidate his insurance and that's the last thing you want.
Deal with it through the appropriate manner.
The guy may not want to give his address as he might be worried about getting a brick through his window.
I'm not suggesting you have been confrontational in any way, but I hope you can appreciate what it might be like for him having driven into someone's car.
Lisyloo _ I haven't left a message or anything like that, we have phoned him twice when his mobile was switched on and he didn't answer. He said he would ring my partner with his details and he didn't. She rang him through his work ONCE to ascertain who he is because she only had his name and a mobile number which was switched off, no car reg or insurance details - Autoreplace got his car reg off him.
I am not stalking this guy or anything like -More Than said to Autoreplace that they could not proceed without a postcode which they then requested from him - neither I or my partner have had any more dealings with him. He ran into the back of her and I couldn't get any details without which it looked to me her insurance would count this as a claim against her. Now I have a car reg I will contact her insurers as a named driver and see if they can deal with it.You can't go wrong with carpet bombing...0 -

They could find it if they wanted to.
It's either an ill-informed member of staff or someone trying to motivate you to do their work for them.
I completely understand your motivation to get over any obstacles, but it's the insurance companies job and there is no reason why they can't do this.0 -
Thanks lisyloo and v_tricky, we've never had to make a claim so thought we needed his insurance details before we could claim - or at least more info than we had - Neither of us have had any contact with him except on the thursday when my girlfrind talked to him and he said he would give her his details. Since then Autoreplace phoned him to try and get details. We were only after his policy no but now from what you have written I have just talked to my partner and she is phoning barclays to put the claim back in their hands now we have his registration that Autoreplace supplied. We don't want to cause any trouble, just get her car fixed.
Also we only found out the name of his (hopefully) insurers through Autoreplace phoning him in the same call as he gave his reg.You can't go wrong with carpet bombing...0 -
Of course it's the insurance company's job, but if borosteve claims of his own insurance, they will deal with it of course - in their own sweet time. Meanwhile borosteve is without his £350 excess while the claim drags on for months into years (as you said!)
IMHO if borosteve can persuade someone at morethan (or his own insurer) to actually do a MID check, and they do confirm that they are the insurer, then he can at least get the ball rolling promptly. The person he spoke to at Morethan may not have external access to MID (having some knowledge of their computer systems, most MID checks are done once a claim has been registered, and not that many staff may have retained their experian ID's and kept upto date with their passwords).
Once the claim is actually registered (either by him, or his insurer) with Morethan then they should be able to help him pretty promptly, but as has been said, sometimes the person who picks up the phone is either ill informed, or just plain lazyAll posts made are my own opinions and constitute neither professional advice nor the opinions of my employers

Thanks v_tricky, my girlfriend has just phoned barclays from work to re-enter the claim and they are checking the insurance database but hopefully with his car registration we can get this sorted. strictly speaking you should not do this if you are not the owner of the vehicle, but enter his reg no on this site and it will tell you if he is insured. Unfortunately, it won't tell you who with.

All indications so far are that he has insurance.

Does your OH have legal assistant as part of her policy? If so she can use them to persue the driver if the insurers fail.

I don't think that's true.
If the insurers fail it will be for a valid reason e.g. he has no money or no insurance.
In this case the legal assistance people are in no better posistion.0
