No fault accident other driver won't give details - please help!!

Can anyone help please?
My partner had an accident on thursday morning on the way to work - someone ran into the back of her. They admitted liability and gave her their name and mobile number - neither of them had a pen. He rang her from his mobile there and then to get his number and said he would ring later with his details.
She reported it to the police who said they weren't interested.
When she rang me to tell me what had happened (about an hour later) I told her to ring him and get his insurance details and his phone was switched off. she tried again about an hour later and it still was. She told me that he had said where he worked so I told her to try him there (to prove he existed as much as anything else) which she did at 1pm and got through to him. He said he had been late for work and had left his phone and documents in the car and would ring her (she gave him house number as well as mobile) that afternoon. By 8.30 he hadn't so I tried ringing him and it rang through to answerphone.
She talked to her insurance who were not very helpful saying that she could claim on her insurance and pay the £350 excess and they would TRY to recover this from the other driver but if they couldn't she would lose her 2 years no claims!
The next morning she rang and texted him (once each) to ask for his details and got no reply. In the afternoon I noticed an article in her union magazine about a company that tries to recover your cost of repairs for you and gave them a ring, giving them the details we had including his work number. Twenty minutes later they rang back saying he had admitted liability to them, given them his licence plate index (which is correct for the type of car) and told them he was insured with M*** T*** and would give policy details today.
This morning they have rang back saying he is filtering his calls at work and is constantly "engaged" according to the switchboard and M*** T*** say they can't search for him without a postcode.
Does anyone know what else we can do? I've tried 192.com and can't find anything on him from the area he said he was living. We've got his name, car reg, mobile and work number and don't know where to go from here. If anyone has any ideas please help.

    You put a claim in against your insurance giving the info you do have about the other driver and his refusal to provide details. They will take it further and will be able to find out who his insurance is with. Failure to provide insurance details may constitute to an offence.

  • Thanks, when she phoned them first time she only had his mobile and name. Can her insurers make him give his details? Its just that Autoreplace had no luck. Even though he has admitted liability to her and Autoreplace can he still try to wriggle out of it now and leave her claiming on her policy?

    Perhaps he doesn't have insurance and that's why he's dodging your calls etc. I don't know if there's any way to check whether a driver is insured but surely your gilrfriend's insurance company should take over the claim and pursue him?

  • they should be able to check on dvla database and i think there is another one insurers use by using the reg number , the reason the insurers are saying they will 'try' and recover from the tp is that it is possible the tp may not be insured if this turns out to be the case then contact police
  • I totally agree but I'm a little worried why they asked her to pay the excess upfront and the bit about trying to claim off someone else afterwards? I just get the feeling that if she does this they won't bother trying to trace this other party.

  • Oops another post came in before my reply - thanks lovebugfamily that makes sense. It was a 54 plate car that hit her so hopefully he will be insured. The only reason I was worried is her car is only worth about £2.5k so if she has to claim she will lose her £350 excess and both years no claims putting her about £800 down over the next few years when there is a crack to the bumper and a small dent but its still driveable.
    Does anyone know if her insurance company would be prepared to give her HIS insurance details (presuming he's got it) and let this Autoreplace company chase him on her behalf?

  • You could enter car reg, car make etc on your mobile for future reference. Save it as a text message. Never trust someone to get back to you.

    You always pay the excess up front. You claim it back via your solicitors/legal team along with other out of pocket expenses.

    The fastest way for More Than to trace to find this persons details is by doing a MID check on his registration number. Give them a ring straight through to their third party claims unit:

    Third party claims with injury : 0845 075 5111
    Third party claims without injury : 0845 075 5104

    As they insure the vehicle, it should immediately come up with the full policy details, including the vehicle make model, and all his address details. If they don't insure him, it will just come up with the policy number, phone number and name of the insurer who does.

    The exception in some cases is if it's a company policy where they may not have every vehicle registered, but they are in the minority.

    Another way Morethan can trace for claims is by reducing the search criteria to just the date in question (if he's reported it at all).

    If he's not reported it to them though, your own insurer can do a DVLA check as per the postee said above, which will take 24 hours for the results to come back by email with the registered keeper details. Morethan wont do that for you though, your own insurer or ULR representative will have to do it.

    Hopefully though if you yourself give his insurers a ring they should do a quick MID check (ask them to do this for you) and then you can take it from there.

    If, once they have hopefully found the claim details, he has confirmed to them that he accepts responsibility for the accident, you can ask them to deal with your claim pro-actively - ie they will arrange for your repairs and no excess will be payable.

    Problem is I know that, it happened to my girlfriend and she was a bit shocked at the time and didn't think straight. Thing is we now have name (not 100% of spelling), car reg and make, mobile number and place of work so what to do next is what I'm trying to ascertain.
