  • Hi Bethesda, I was on benefits when the overpayment happened. I'm just filling out my dispute form now as the overpayment is huge even though they were given the correct information!! bex879165.

    My daughter has just received word that she has been underpaid approx £1,000 by the working tax credit people. She took the information to the citizens advice centre who phoned the tax office on her behalf and they were informed that this was correct. Both she and Citizens advice think this may be incorrect. She has set the money aside [although she really could with the money as she works for a mental health charity and the pay is very poor and the shift work draining]
    Anyway, now my question
    If the tax office eventually finds that they have made a mistake and over paid her, is there a stature of limitations whereby too much time has passed that they can't claim the money back?

    Quiet Life - I'm not sure about that, my alleged 'overpayment' dates back to the 2002-03 year and they haven't stopped trying to get it out of me as yet, although I am currently fighting it.

    I think getting copies of your P60's if you can't find them would be a good idea anyway as you never know when you need them ;) Then I'd suggest getting on the Tax Credit Casualties forum as they are better equipped than we are here in dealing with these problems :D

  • i was underpayed for various years stretching back to 2005. i received cheques in the summer 2009 which i used to spruce up my house and just have a good summer.
    yesterday is hould have received my regular mothly payment for child tax credits. it didn't appear so i phoned the helpline, who told me that my payment had been stopped as there was an overpayment, i told them that i needed this money (i had a direct debit for fuel coming out today, for which my bank is going to charge me as i haven't got the funds to cover it). this overpayment was for a previous year 2005. i said i had actually been underpayed for which i received a cheque for that year in the summer. they said they would investigate and after about an hour phoned me back. they said that they had made a mistake and someone had put the figures for 2005 into this year's account. i am fuming. i will be charged by my bank and it's all the tax office's fault! and they said they couldn't tell me when i will get my child tax credits! very annoyed and angry. :mad::mad::mad::mad:

    Just wanted to let everyone on here currently disputing overpayments that I received a phone call a week or two ago to apologise for all the problems and my overpayments are incorrect and will be cancelled I also recieved a nice cheque in the post for money I was underpaid! Please look on the http://www.taxcc.org/
    as they give you a step by step guide to disputing claims and do also give really good advice on their forums. I have had to shut my old claim and open a new claim for my CTC as they told me due to some computer error my current claim will always come back as having errors and will ask me for all CTC back even though it is correct. Hope this gives some people a bit of hope Ias I had resigned myself to having to pay mine back.
  • I am not happy with the way the working tax credits run. I mean they are saying I owe just under £4000 from 2006/7 and 2007/8 I have sent in evidence to state that at the time they were informed that I was not due this money as I was earning to much speaking to manager who stated to me that the computer said I was, so it was alright. I must of spoken to about 10 different managers through the yr making sure that I was able to receive the money. Every time I rang up I was always telling them how much wages I was receiving but as usually it was never written in to correct boxes on the computer, as I thought the thresh hold must of gone up. As I say I kept everything written down and another thing the money they were giving me was never given to me weekly, for example once £600 was given to me just like that. Immediately I rang up the tax credits helpline to ask why I had been given this and again the response was the computer says I am owed it.

    Since Jan 2008 I have been going through the various disputes and even had the local MP and a local benefits agency shop looking into it as myself was just banging my head against the wall. In 2008 roughly april my second dispute was sent in and it took them a yr and two months too come back to me with me ringing the help line on various occasions asking what was happening to be given the reply off its still been looking into. Is this procedure correct? Anyways since November again I have not heard anything from the tax credits as I thought my MP and the benefits agency shop were still looking into it and yesterday 25th of March I receive a letter which is headed Notice warning of legal proceedings. This virtually made me sick as I thought it was still being looked into as it seems like the tax credits are just by passing my complaint now.

    I am not sure what to do and am hoping someone can advice me please

    I agree with you. I don't get tax credits but, if I did, I would inform them by telephone and also send a letter by registered post (£4.95) then if they come trying to get money back I would then tell them to pi** off. I would have all the evidence I needed if I had correctly filled in the application form and told them every step of the way.
