tax credit overpayments new report published

Do you know her details ?, try and run it through a tax credit calc and see what ot comes out as.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

my husband was overpaid wtc in 04/05 they had all the correct info on form salary etc kids dissabillitys. I did pick up that the amount paying was incorrect and that hubby should not get wtc at all but when i rang they said it was correct i said no it wasn't, she got very unpleasant and said we were do the award,conversation ended i wasnt happy, so phoned back later that day and someone believed me he wrote notes on computer and sent them through to another department.
three weeks later we got an updated award notice saying the same thing i wrang they said it was correct, i was pulling my hair out at this stage but hubby said we've told them let them get on with it.
as you can guess in october we got the letter we have been overpaid money stopped. we did get some hardship money.Anyway appealed they said no as we should have been aware i said yes i was aware but your staff wouldnt listen, we eventually got 1 amount of £1586 wrote off but they still claiming the other £2500.We have just had or overpayment suspended as i found some new information they wanted fingers crossed this time they might stop taking it altogether, they have said that if we are correct then all they have took off us this year will be repaid to us in a lump sum.
keep up with the fight the most important thing is times and dates and to get hold of the records they hold, this we have now done and fingers crossed we might get somewhere.0 -

Well that is blinkin ridiculous! :mad: how can they demand that money back? knowing that they made the error and would not listen to you. What were you supposed to do?
Ok so does my friend really have a leg to stand on. It seems as if they make an error it is our fault, if they calculate wrong it is our fault, if we tell them it is wrong it is still our fault.can we win this?

She does stand a chance but as i say times and dates are very crucial if she had any dealings on the phone,Get hold of the conversations from them, from first date she rang or gave information.make sure she has all copies of award notices sent.
copies of phone bill also come in handy if you can get hold of them.0 -

When we originally wrote a complaint I was pregnant with our 2nd child and we wrote in the letter that this was causing me needless stress - we received a cheque for £40 with a letter which we were disgusted by. It felt like they were saying here's £40 now shut up! :lipsrseal Needless to say we didn't give up and now nearly 3 years on we're waiting for the Parliamentary Ombudsman (referred by our MP) to sort it out for us.

THe same as this has happened to me and my husband seperately over the last couple of years. (We were both single parents when we met). Anyway when we got the notifications in January 05 I looked through everything and then wrote appealing on both accounts. We had both informed them of all changes and as I had moved a few hundred miles to live with him I had even more proof as I used to pay childcare when on my own which I ceased to need when I moved. My money stopped and as far as we were concerned that should be that. Anyway - put our letters of appeal in and in March/April time hubby got a letter clearing all arrears. In September I got a letter saying that the £7,000 odd that they had apparently over paid was not an overpayment (They said it was an overpayment as I was married, with 3 children and a full time job from the April - however I found it difficult that I could be married to someone I had not yet met, lived hundreds of miles away and was working part time with 2 children..............OOOPS sorry madam, I see your point!!!!!! - all sorted out and payments for 05/06 worked out......... all informed again of change of address, return to work etc and have today received a letter from them stating that they have apparently UNDERPAID me for 04/05 as I was a single parent!!!!!!!!! ARRGGGHHH - here we go again.........
Keep with it however it is worth it in the end.........0 -

just to update today we have had a letter from them saying
"IT was not reasonable for us to think the payments were correct"
This is the whole point from the date the first overpayment went into our bank, which was the first day we recieved award notice i rang them and told them it was wrong,She said they were right.I again rang back later and they agreed they were wrong he put notes on screen THEY FAILED TO ACT THERE FAULT NOT MINE. They are not listening or reading notes, i have now written to my mp.0 -
Hi people!
I dont mean to be rude, but if you knew you were being overpaid on your tax credit, why did you then spend the money you were being overpaid, and not telling the powers that be, NOT spend the amount that is overpaid, and give them the overpaid monies back when they ask for it?0
