Could any please help ??
I got a new PC from Comet on Monday 21-01-08.
and it does not work properly the Harddrive seems broke.
i rang the shop whom refused a refund as they said it was a warranty issues.
but i remember that it was there responsibility. as the goods are only 6 days old and fault reported three days ago.
i want to go to the shop tomorrow and get a full refund but the manager was rude and said there will be not point.
could any one give me a little pointer to get a full refund.

What do you mean by "the Harddrive seems broke"? You don't seem to be very sure if there's a problem with the computer or not.0 -
Yes there is a problem with the hard drive the thing is six days old and makes a lot a wearing and has crashed as of data dumps. thus meaning writing to harddrive is a issue.

I'm sorry but if you're going to try for a refund you'll have to make the problem a lot clearer than that using examples of what exactly happens and when. Computers as you know aren't like, for example a kettle which either works or it doesn't. Your problems could easily be down to software.
You'll have to clarify whether the computer was working initially and has since developed a fault and state whether you have installed other software.
If it is faulty and not a software problem then the following will answer your question.

Yes there was a fault at the start. the Harddrive was always making the noise.
and yes there has been software loaded on to it this is who i know there is a problem as it sounds as though its scratching always wearing sound.
Just a point i want a refund out of principle as when asked about the fault the shop passed the buck and a flat refusal.
is it not a consumer right to get a refund in under seven days if not 100% happy.

erm some hard drives make loads of noise - your problem oculd be loads of things like memory, graphics card or any other piece of hardware malfunctioning - even a corrupt install of the os.
I suggest that before you go ranting and raving that you correctly diagnose the problem0 -
How did you pay for the computer? If by CC then tell the Manager you will stop the transaction unless they replace the computer/refund. I agree though that you need to have a thought out complaint with detail before going into the shop. Your posts are not very clear or informative. Write down in detail what happens from when you boot the PC to the start of the fault. State that it was present from the point of sale. Would you accept a replacement? if not why?.
I had a similar issue with Dell,followed all the above and had a replacement within 10 days. Be firm,polite and know the problems and your rights. Good luck.0 -
Believing that the system was faulty right from the start begs the question as to why you loaded additional software rather than taking it straight back.
The 7 day period you mention applies to "distance" purchases made by telephone or online. In your case you cannot simply chose to return the goods if you have changed your mind about them. If there is a fault Comet will have to be given the opportunity of confirming it and as you reported it so soon after purchasing it then a full refund should be forthcoming. My only worry is that in loading your own software you indicated acceptance of the product as there was no need to install other software to test it out so perhaps resetting it to its initial condition would be wise. You will have to be prepared to stand your ground in the shop and insist on demonstrating the problem there and then - a couple of minutes to hook it up to a monitor shouldn't be beyond their capabilities. Assuming that the noise is not simply normal hard drive noise but is indeed an indication of a faulty drive then you should have no problem in getting the matter sorted. Personally If it were me I would simply ask for a replacement as presumably you like the computer otherwise you wouldn't have bought it in the first place. After all a dodgy hard drive - assuming it is faulty - is not exactly a rare occurence and is easily remedied. If you can't demonstrate a fault then don't expect them to do anything.0 -
It's not a faulty hard drive - I can almost guarantee it. For a new modern hard drive to be making noise due to being faulty you would never have got to the stage of installing other software.
If you want to prove the hd is faulty get a copy of maxblast (from maxtor) or seagate seatools or something similar and use it to check the hd.0 -

the thing i want to know is would you except being told the new computer you got is not working right but that's not the shops fault. so they will not give a refund till i ring some line to spend a little more of my money then to be told they will take it away and fix it . typing this note the computer cannot keep up with the typing.
its a duel core that's slower than the P3 i have replaced. have been typing and page has been unresponsive three times burning data onto a disk slower the thing up .
could any one just tell me what to say to get
A) Re-placement with out waiting ora refund so i can get a new comp from a other more user friendly store.

You are not obliged to accept a repair.....but you will have to wait for a replacement to be delivered unless they can ofer you the same one"off the shelf". I had to wait 7/10 days till a new one arrived but I had the leverage of telling them that unless they offered a replacement I would immediately cancel the transaction.0
