    30% proportionate is it?!

By your logic, then, plenty of goods and services sold in the UK are not 'proportionate' and could therefore be claimed back and are unfair.

E.g. the mark-up on furniture is usually more than 30% so is that 'unfair' and could you, using the same argument, claim some of the profit back on the sofa you bought?

Please refer to my original post. It does not have to be proportionate to the amount you pay or owe, it has to be proportionate to the work done by the service provider.

according to my friends mum who is an accountant, she says i can claim the charges back, instead of all slating me, why dont you try and be helpful?

But she didn't advise you to keep your end of the bargain by PAYING ON TIME?

It's a win-win solution - you won't pay any charges then (except interest) and the bank won't have to keep chasing you and charging you for running your account badly!!

Evidently the OP didn't live by their own words posted back in Oct 07

".... as I have finally grown up and want to become a person who has control over their life"

..which evidently didn't include their finances, or indeed, taking any degree of responsiblity for their own errors.

i mean £12 in relation to what i should be paying any way isnt a fair percentage

Bank and credit card charges are a flat fee, not based as a percentage of what you didn't pay. It is designed to cover the cost to the CC company not as a fine.

I think you will find that £12 is generally seen as a fair charge.

Yes, you are right. The charges are ILLEGAL and the CC company should be taken to task.

Get another credit card and use it to pay a barrister to take up your case. I'm sure you will win.

    Is that better?
