late charges of £12

i have just realised that i have been paying late payment charges of £12 and i have no idea for how long

what it is that bothers me is that i pay the minimum of £40 a month and i am sometimes late with it, which i cant help at least i pay what i can when i can surely,

what i want to no is, is this fair and can i recalim this back? i mean £12 in relation to what i should be paying any way isnt a fair percentage

thats a 30% fine ! WHOA! thats harsh

please can i have some advise (i havent got previous statments so i have no idea how many i have paid :s )

    Why can't you help paying late? The debt is your responsibility and your CC company is there to make money and profit.
    If you couldn't afford to make the payments on time then you shouldn't have racked up the debt to begin with.
    Additionally, the charges are part of the T&Cs that you agreed to when you took the credit card up (or, possibly, have been amended since, in which case you would still have been aware of them).

    You agreed to it being 'fair' when you took the card up and agreed to the T&Cs.
  • We mustn't get carried away with thinking everything has to be fair.

    A few years ago, I was fined £60 for driving at 35 mph in a 30 mph zone. A friend was fined exactly the same for doing 45 mph in the same zone.

    Even more years ago, I was fined £30 for overstaying the car park. Parking was 20p per hour and I overstayed for 30 minutes.

    Take charge of your life for crying out loud.

    If charges were fair they would be ineffective.

    The fine does not relate to the amount that you pay (though how can you not help paying late?!), it relates to the amount that it costs to process the late payment.

    My advice would be to get better organised in making your payments.

  • according to my friends mum who is an accountant, she says i can claim the charges back, instead of all slating me, why dont you try and be helpful?

    Accountants have nothing to do with reclaiming charges, so her advice is no more reliable than anybody elses.

    If the charge was e.g. £30+, you may have a case for arguing that the charge is unreasonable. But £12 is (arguably) not an unreasonable amount for the admin that goes into the work that a late payment produces.

    Out of interest, what do you think would be a fair charge?!

    The OP clearly pays no attention to his/her finances, e.g. stating they have 'no idea' how long they have been paying late charges for, evidently not bothering to open credit card statements, etc.

    Additionally, the OP implicitly felt the charge was 'fair' enough when they opened the card, but not when they couldn't be bothered enough to organise their finances properly.
  • Of course, if you had read the terms & conditions when you got your back account, this was in there(the charge amount). Yet that’s irrelevant: a contract must be written within the law, and they can’t enforce a contract with legally unfair terms. Ultimately, if it isn't proportionate then it's unlawful, and thus you've a right to your money back.
