can anyone give any advice?

hi all,
I bought a 2 seater and 3 seater settee from land of leather, on the 11th january this year i had the option to pay £69.00 for delivery or collect myself, i collected the settees and when igot them home the 3 seater was faulty the mechanism on the recliner needed fixing the sette also had marks on it my OH immediately phoned land of leather and they said they would send a technician out, well he came out today and said he would fix the mechanism, i said no i would phone the company, he rang them himself and told them also, i told them i didn't want it fixed has i did not expect to buy a settee that was faulty, i want a replacement they have said no way!!! i then rang trading standards and have said under the sales goods act of 1979 it sttates that if it is not satisfactory and i have let the company know within reasonable time they should replace it, my OH went into the shop and they were still saying it will be returned and we will be refunded or repaired i then looked at the contract which stated that the goods will be replaced if it is within a reasonable time.... i phoned the store again and stated this to the manager he said he had to speak to his area mamnager, he rang back, and told us again we will not get a replacement, i phoned back after and asked for the area managers number he said there isn't a number? and gave the address to contact him, i checked the address and it is a delivery depot in leeds, while on the phone to him he then said i was threatening him all because i quoted the sales of goods on their contract?
can anyone give me any advice?

I dont think the company is under any obligation to replace the whole sofa if they are able to repair it to a state equivelant to an as new condition.
You might be better to let the company try to do the repair first and then if it is not as good as new take things further.0 -
I agree. Give them the opportunity to repair the mechanism before demanding a replacement. As for the marks, I don't think you can do anything about them as you didn't point them out in the shop and they could have been done subsequently.0

hi andy the marks were not done in the shop the settee was collected new from the depot on the 11th january in a box?
i have phoned someone in the company who says all land of leather settees come over in containers and the fault was probably done when they were stacked up then.!!!!
i have tries to explain that i bought the suite new and collected it from a warehouse depot and i would expect a brand new suite to have no faults but they seem to think that doesn't matter!!!!!!0 -

Telephone the AMU immediately (Association of Master Upholsterers) 029 20778918 they will help you to arbitrate in a case like this and tell you all your legal rights and how to go about it.

Don't be fobbed off by them, you do have rights as far as the marks and fault are concerned, it is up to them to prove it was perfect when it left the shop, not up to you to prove that it wasn't.;)
I too would get it replaced, a brand new settee should surely have passed through some sort of quality control.0
