    there is nothing legally stopping you from issuing a 3 months AST

    it is not about "preferences" of either students or other tenants or landlords - it is the law - you now have to deposit a deposit in a scheme or buy into the insurance backed scheme.

    tenants have to give only one months notice on an AST - i do not see your point in trying to "get around" the AST-deposit scenario on these grounds ??

  • Hi all, just to update you on the Deposit Protection Scheme where I lodged my last tenants deposit. Having flooded out the place and was constantly late with the rent, she decided to leave without notice and without giving a forwarding address.I contacted the DPS and to cut along story short I am still waiting for the Single claim forms which I was assured were sent on 10 March. When the tenant skips out, you have to complete a Statuary Declaration Form, have it witnessed by a solicitor or a commissioner of oaths, then complete the single claim form and return them all to the DPS.As my tenant left at the end of January it will be some months before I get the money in my account. In future, I intend getting the new tenants to give me their ID no so that I can shortcut the whole process, and also I intend photocopying the relevant forms so that I wont need to wait for the DPS to get off their backsides!

    DiamondDave I have also just gone through this process although without the damage, yes it is tedious esp when the bulk of the delay is getting the right form, but once you have a copy of it then you can submit your claim straight away. ( I would strongly recommend you get DPS to put another in the post)

    I doubt it is legal to have the tenant ID and speaking as a LL if I were your tenant I would feel wrong footed straight away. You can't treat everyone the same but you can learn from experience.

    Best thing to do is get a guarantor or at very least have contact details for next of kin, that way if a tenant skips out you will have someone else to chase for the money and they will more than likely give you the ex-tenants new contact details.

    Shazza - it's more straightforward if you start your own thread, as although it's all about deposits it can get confusing for everyone to follow, especially if a bit of DGJsaver and GG table tennis is thrown in for good measure.;)
