Tenancy Deposit Schemes - Advice Please

    Hi can you give me more information about using a non-housing act tenancy agreement. I am thinking of using this to avoid the rigamarole of the TDS because I have number of students renting who come and go (part of the sell is it's easy to leave). Thanks

    I would recommend taking a deposit - even from family/friends. If they cannot afford the deposit, it is unlikely that the rent will be paid on time.

    shazza in that case yes - your deposit should be in a scheme and you should have been informed which scheme and all the details to allow you to look it up on the web (if it is in the deposit scheme, rather than the insurance scheme)

    FYI:

    - I am aware that the deposit money isn’t mine – I happen to be one of the MAJORITY of landlords who don’t rip off their tenants
    - Since my tenants are students, they like the fact that they only have to give me a month’s notice to move out. The TDS ensures more paperwork and cost whenever anyone moves out which means I would no longer be able to offer this easy get out to them and would be forced to use a 6 month AST. I promise you they much prefer this flexibility over being “protected” from the Big Bad Landlord you think I am.

    PS you sound like the kind of person who enjoys making snap judgements from very little info and then getting really, really annoyed about it. Each to his/her own.

    How is anyone supposed to make judgments any other way when you type what you type ?

    DPS is a free scheme - does not cost you to deposit or get deposit back out again

    there is nothing legally stopping you from issuing a 3 months AST

    it is not about "preferences" of either students or other tenants or landlords - it is the law - you now have to deposit a deposit in a scheme or buy into the insurance backed scheme.

    tenants have to give only one months notice on an AST - i do not see your point in trying to "get around" the AST-deposit scenario on these grounds ??
