Building Regs/No Planning On extension..

    thanks a lot for everyones help!! Its really appreciated..

    I've been in touch with the council and they have no record of it at all..I've got a structural engineer coming out on monday, he was quite bemused by it also and told me that he will only do a visual inspection so cannot check anything he cant get at or see, which kind of defeats the objective really. He also asked if a survey was done which it was and no problems were reported..

    Another concern I have is if he reports a list of faults and the buyer starts asking for money off left, right and centre.. Basically the buyer has me by the proverbial..

    All I want really is for him to report that the building looks to be completed according to 1992 regs.. Guess I wont be moving friday!!!

    You can't get indemnity insurance because:
    I've been in touch with the council and they have no record of it at all

    That was the one thing not to do in this kind of case.

    So should you never seek copies of certificates, in case they are not available? Seems mad that there must be thousands of indemnity policies issued because the vendor is too scared to ask for a duplicate, must be an absolute packet being made.

    especially around the issue of chancel insurance, we just paid 60 quid for ours without knowing whether there is chancel liability, becauase if we knew there was liability we wouldnt be able to get insured against it and so on.......

    If there is building regs approval it will show in the local searches. When it isn't in the search, that is when it gets raised.

    But aren't the local searches also raising the issue? Who gets to do a search that doesn't count as drawin attention to it?

    Virtually every house that is sold has a Local Authority Search carried out on it. It is not specifically a search asking for a record on specific work, it is a standard question where all planning permissions and building regs bounce back on the property. If the solicitor knows works have been carried out that require approval but they are not in the search, this is where it is queried.

    Drawing Building Control's attention to it would be specifically contacting to find out if work carried out had been approved. Because it is then that you alerting them that work has been carried out and basically inviting them to take action or at least come and look.

    A standard search simply requests what info they have, not what info they don't, iyswim.
