  • If the company doesn't back down once they receive the letter, then when you make your claim, you will be perfectly entitled to add in the remainder of the contract. i.e. if it's 12month at £30 then add £360 to what you are requesting. That way, you can write off the outstanding contract at THERE expense.

    If you had to go to court (bet you don't!) the contract would probably declared void as the faulty mobile phone is 'integral' to the contract. Put simply, you can't exercise your rights under the contract without the means to do so. Given that the shop will be wanting at all costs to avoid paying your outstanding contract, I suspect that they will give in graciously. Something like.......'giving your such a valuable customer, or we've looked again and as a gesture of goodwill.......'. Both will be flannel, as what they won't be saying is 'We were talking rubbish'.
