Sold a faulty machine that I paid £300 for on ebay, Help regarding refund

your only recourse is the small claims court and even then you are not guaranteed your money back as a win still requires you to chase seller for the money. It might be worth writing a snail mail letter to the seller and sending it recorded delivery so you have proof of receipt, saying that the item was misdescribed and that you therefore require a full refund. Then if that does not work, which it probably won't another letter stating that papers will be filed with the court.
If it does go to small claims you will almost certainly have to travel to the court nearer the seller.
I know I will be shot down in flames for saying this, but, sometimes there is a very good reason why sellers won't take paypal on a used item. If they know they are mis selling something they don't want the buyer to automatically get their money back.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I would hound her, send emails, letters etc.. tell her you will inform the bank of her 'scam'...
You have an engineers report to confirm the machine does not work and would not have been damaged to that extent in transit...
Small claims court costs £30 if I remember correctly, advise her you have got an engineers report and will be taking her to the small claims court.
See what she says.. it's difficult but without PayPal you may struggle unless you can somehow bully her into repaying you and accepting it back.
Soolins post is spot on..! Well said...
Good Luck x

Quite right soolin,Now then there are 2 ways around this,Firstly the court scenario, and the second is to put your foot down and be a thorn in their side.Negative feedback is your first line of defence let other people know what has happened this way.Keep it to the point though.
She isn't doing that bad either on the sales,is she really a private seller.0 -
Do what Soolin says - tell them that you have all the evidence to take them to small claims, and give them a time limit in which to respond. If they're sensible, they'll offer to take it back.
If they're either silly or truthful (as unlikely as it sounds from your description), and you don't get a positive response within your timeframe, file for small claims.Mortgage | £145,000Unsecured Debt | [strike]£7,000[/strike] £0 Lodgers | |0 -
I think if you really want your money back you might have to put a bit of effort in here.. it's the principle that counts, and if you are prepared to shell out another £30 then I think it will be worth it.
Too many sellers on eBay think they are above the law and can do what they like..

I suspect she used paypal for buying but not for selling as she has bought items from the USA. Her ESR stars are not too good either.0

There's another auction running for upgraded software to PE 7...on that listing, it says it cannot be used to upgrade PE2...in the auction you've won, the seller lists the item comes with PE2 and PE4. I have a strange feeling that the seller tried to upgrade her machine to PE4, which was quite possibly not compatible with a machine running PE2, hence the programming problems picked up by your engineer. If that's the case, your seller definitely knew the machine wasn't working. I could be wrong, mind...
One more thing - how could the seller be certain it worked fine, if she didn't have the power cord? Did you ask the seller why the power cord was not included in the sale?In a rut? Can't get out? Don't know why?
It's time to make that change.
